   read once and referred to the Committee on Racing and Wagering
 
 AN ACT to amend the racing, pari-mutuel wagering and  breeding  law,  in
   relation to distributing purse monies more equitably
 
   THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
 BLY, DO ENACT AS FOLLOWS:

   Section 1. Subdivision 9 of section 208  of  the  racing,  pari-mutuel
 wagering  and  breeding  law is amended by adding a new paragraph (f) to
 read as follows:
   (F) NOTWITHSTANDING ANY OTHER LAW  TO  THE  CONTRARY,  THE  FRANCHISED
 CORPORATION OR THE HORSEMEN'S BOOKKEEPER SHALL NOT ALLOCATE OR SPEND ANY
 MONIES  FROM AN ACCOUNT ESTABLISHED PURSUANT TO THIS SECTION WITHOUT THE
 PRIOR WRITTEN CONSENT OF THE NEW YORK  THOROUGHBRED  HORSEMEN'S  ASSOCI-
 ATION  REPRESENTING AT LEAST FIFTY-ONE PERCENT OF THE HORSEMEN USING THE
 FACILITIES OF THE FRANCHISED CORPORATION, PROVIDED HOWEVER, ANY  PAYMENT
 OBLIGATION PROVIDED FOR IN LAW FROM THE ACCOUNTS ESTABLISHED PURSUANT TO
 THIS SECTION SHALL NOT REQUIRE WRITTEN CONSENT.
   § 2. This act shall take effect immediately.
