Cunningham) -- read once and referred to the Committee on Transportation AN ACT to amend the vehicle and traffic law, in relation to establishing a reimbursement program encouraging persons to scrap such person's petroleum or diesel motor vehicle to purchase a zero emission or elec- tric motor vehicle THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. The vehicle and traffic law is amended by adding a new section 224-b to read as follows: § 224-B. ESTABLISHMENT OF THE SCRAP FOR ELECTRIC VEHICLE PROGRAM. 1. FOR THE PURPOSES OF THIS SECTION, "ELIGIBLE VEHICLE" MEANS AND INCLUDES A NEW MOTOR VEHICLE THAT: (A) HAS FOUR WHEELS; (B) WAS MANUFACTURED FOR USE PRIMARILY ON PUBLIC STREETS, ROADS AND HIGHWAYS; (C) THE POWERTRAIN OF WHICH HAS NOT BEEN MODIFIED FROM THE ORIGINAL MANUFACTURER'S SPECIFICATIONS; (D) IS RATED AT NOT MORE THAN EIGHT THOUSAND FIVE HUNDRED POUNDS GROSS VEHICLE WEIGHT; AND (E) IS PROPELLED AT LEAST IN PART BY AN ELECTRIC MOTOR AND ASSOCIATED POWER ELECTRONICS WHICH PROVIDE ACCELERATION TORQUE TO THE DRIVE WHEELS SOMETIME DURING NORMAL VEHICLE OPERATION, AND THAT DRAWS ELECTRICITY FROM A HYDROGEN FUEL CELL OR FROM A BATTERY THAT: (I) HAS A CAPACITY OF NOT LESS THAN FOUR KILOWATT HOURS; AND (II) IS CAPABLE OF BEING RECHARGED FROM AN EXTERNAL SOURCE OF ELEC- TRICITY. 2. THE DEPARTMENT SHALL DEVELOP A PROGRAM TO ENCOURAGE PERSONS TO SCRAP SUCH PERSON'S PETROLEUM OR DIESEL MOTOR VEHICLE TO PURCHASE A ZERO EMISSION OR ELECTRIC MOTOR VEHICLE. SUCH PROGRAM SHALL INCLUDE A REBATE FOR PURCHASING SUCH ELIGIBLE VEHICLE PROVIDED THAT A REBATE FOR PURCHAS- ING SUCH ELIGIBLE VEHICLE SHALL NOT EXCEED FIVE HUNDRED DOLLARS. 3. THE DEPARTMENT SHALL DETERMINE AND ESTABLISH THE FORMS TO BE REQUIRED TO CLAIM A REBATE, THE REQUIRED DOCUMENTATION FOR ESTABLISHING EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted.
