McDONALD, WOERNER -- read once and referred to the Committee on Alcoholism and Drug Abuse AN ACT to amend the mental hygiene law, in relation to reimbursement for non-medical transportation for individuals with a substance use disor- der to receive services from a peer THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. The mental hygiene law is amended by adding a new section 19.18-d to read as follows: § 19.18-D REIMBURSEMENT FOR PEER AND TRANSPORTATION SERVICES. THE OFFICE SHALL ESTABLISH REIMBURSEMENT RATES FOR NON-MEDICAL TRANS- PORTATION FOR INDIVIDUALS WITH A SUBSTANCE USE DISORDER TO RECEIVE SERVICES FROM A PEER CERTIFIED BY THE OFFICE OF ADDICTION SERVICES AND SUPPORTS. AS PART OF THE DEVELOPMENT OF SUCH RATES, THE OFFICE, IN CONSULTATION WITH THE DEPARTMENT OF HEALTH, SHALL PURSUE FEDERAL MEDI- CAID PARTICIPATION AND REIMBURSEMENT. THE OFFICE SHALL ALSO CONSIDER THE USE OF ANY FEDERAL GRANTS, INCLUDING STATE OPIOID RESPONSE GRANTS AND SUPPLEMENTAL SUBSTANCE ABUSE PREVENTION AND TREATMENT BLOCK GRANTS, TO SUPPORT SUCH REIMBURSEMENT. SUCH REIMBURSEMENT RATES SHALL BE ESTAB- LISHED BY JANUARY FIRST, TWO THOUSAND TWENTY-FOUR. § 2. This act shall take effect immediately.
