 AN  ACT  to  amend  the  general business law, in relation to children's
   non-regulated camps
 
   THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section  1.  Section  398-f  of the general business law is amended by
 adding four new subdivisions 4, 5, 6 and 7 to read as follows:
   4. (A) ALL CHILDREN'S NON-REGULATED CAMPS, AS DEFINED  IN  SUBDIVISION
 ONE  OF  THIS  SECTION,  SHALL  REGISTER ANNUALLY WITH THE DEPARTMENT OF
 STATE.
   (B) NO PERSON, FIRM, CORPORATION OR ASSOCIATION SHALL OPERATE IN  THIS
 STATE WITHOUT REGISTERING WITH SUCH DEPARTMENT.
   (C) A KNOWING VIOLATION OF THIS SECTION SHALL BE PUNISHABLE BY A CIVIL
 PENALTY NOT TO EXCEED FIVE HUNDRED DOLLARS FOR EACH VIOLATION.
   5. THE FEE TO REGISTER SHALL BE TWO HUNDRED FIFTY DOLLARS, EXCEPT THAT
 NO  FEE  SHALL BE CHARGED IN THE CASE OF A CHILDREN'S NON-REGULATED CAMP
 OPERATED BY A PERSON, FIRM, CORPORATION OR ASSOCIATION  FOR  CHARITABLE,
 PHILANTHROPIC OR RELIGIOUS PURPOSES.
   6.  THE  DEPARTMENT  OF  STATE  SHALL  SUBMIT  AN ANNUAL REPORT TO THE
 DEPARTMENT OF HEALTH THAT INCLUDES A LIST OF ALL  REGISTERED  CHILDREN'S
 NON-REGULATED  CAMPS  WITHIN  THE STATE; THE LOCATION OF EACH CHILDREN'S
 NON-REGULATED CAMP; HOW MANY CHILDREN ATTEND A CHILDREN'S  NON-REGULATED
 CAMP;  AND  A  LIST  OF  ALL ENTITIES THAT COMMITTED A VIOLATION OF THIS
 SECTION FOR THE PREVIOUS CALENDAR YEAR.
   7. NON-REGULATED CAMPS SHALL NOT BE  REQUIRED  TO  REGISTER  WITH  THE
 DEPARTMENT  UNDER  SUBDIVISION FOUR OF THIS SECTION OR PAY ANY FEE UNDER
 SUBDIVISION FIVE OF THIS SECTION UNTIL THIRTY DAYS AFTER THE  DEPARTMENT
 HAS  PROMULGATED REGULATIONS AND CREATED ANY FORMS AND NOTICES NECESSARY
 FOR A CAMP TO COMPLY WITH SUCH SUBDIVISIONS.
   § 2. This act shall take effect immediately.

 AN ACT to amend the public health law, in relation to children's non-re-
   gulated camps
 
   THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section 1. The public health law is amended by adding  a  new  section
 1408 to read as follows:
   § 1408. CHILDREN'S NON-REGULATED CAMPS. 1.  (A) ALL CHILDREN'S NON-RE-
 GULATED  CAMPS,  AS  DEFINED IN SUBDIVISION ONE OF SECTION THREE HUNDRED
 NINETY-EIGHT-F OF THE GENERAL BUSINESS LAW, SHALL REGISTER ANNUALLY WITH
 THE DEPARTMENT.  SUCH REGISTRATION SHALL INCLUDE  THE  LOCATION  OF  THE
 NON-REGULATED  CAMP AND HOW MANY CHILDREN ATTENDED THE CAMP IN THE PRIOR
 CALENDAR YEAR.
   (B) NO PERSON, FIRM, CORPORATION OR ASSOCIATION SHALL OPERATE IN  THIS
 STATE WITHOUT REGISTERING WITH SUCH DEPARTMENT.
