S T A T E O F N E W Y O R K ________________________________________________________________________ 1305 2023-2024 Regular Sessions I N A S S E M B L Y January 17, 2023 ___________ Introduced by M. of A. SILLITTI -- read once and referred to the Commit- tee on Transportation AN ACT to amend the vehicle and traffic law, in relation to waiving certain fees for distinctive "September eleventh, two thousand one remembrance" license plates for certain first responders THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Section 404-ee of the vehicle and traffic law, as added by chapter 224 of the laws of 2018, is amended by adding a new subdivision 4 to read as follows: 4. (A) NOTWITHSTANDING SUBDIVISION TWO OF THIS SECTION AND THE FEES PRESCRIBED OR PERMITTED BY SECTION FOUR HUNDRED ONE OF THIS ARTICLE, THERE SHALL BE NO CHARGE FOR THE ISSUANCE OF A NUMBER PLATE PURSUANT TO THIS SECTION TO A PERSON WHO SUSTAINED A PERMANENT DISABILITY AS A RESULT OF HIS OR HER PARTICIPATION IN THE RESCUE EFFORT THAT WAS CONDUCTED IN RESPONSE TO THE WORLD TRADE CENTER ATTACK ON SEPTEMBER ELEVENTH, TWO THOUSAND ONE, OR TO THE SPOUSE OF A PERSON WHO SUSTAINED A PERMANENT DISABILITY OR DIED AS A RESULT OF SUCH RESCUE EFFORT. FURTHER- MORE, UPON THE ISSUANCE OF A DISTINCTIVE PLATE PURSUANT TO THIS SECTION, SUCH PERSON SHALL BE EXEMPT FROM THE PAYMENT OF ANY FEES RELATING TO THE REGISTRATION OR RENEWAL THEREOF AS PRESCRIBED BY SECTION FOUR HUNDRED ONE OF THIS ARTICLE. (B) THE FEES AUTHORIZED PURSUANT TO THIS SECTION SHALL BE WAIVED ONLY UPON PROOF, SATISFACTORY TO THE COMMISSIONER, THAT THE APPLICANT OR THE SPOUSE OF THE APPLICANT IS ELIGIBLE FOR SUCH WAIVER OF FEES. § 2. This act shall take effect on the sixtieth day after it shall have become a law. Effective immediately, the addition, amendment and/or repeal of any rule or regulation necessary for the implementation of this act on its effective date are authorized to be made and completed on or before such effective date.
