S T A T E O F N E W Y O R K ________________________________________________________________________ 1504 2023-2024 Regular Sessions I N A S S E M B L Y January 17, 2023 ___________ Introduced by M. of A. L. ROSENTHAL -- read once and referred to the Committee on Codes AN ACT to amend the penal law, in relation to creating the offense of fostering the sale of stolen goods THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. The penal law is amended by added a new section 165.66 to read as follows: § 165.66 FOSTERING THE SALE OF STOLEN GOODS. A PERSON IS GUILTY OF FOSTERING THE SALE OF STOLEN GOODS WHEN: 1. HE OR SHE HOSTS, ADVERTISES, OR OTHERWISE ASSISTS THE SALE OF STOLEN GOODS, INCLUDING ON AN INTERNET WEBSITE; AND 2. HE OR SHE KNEW OR SHOULD HAVE KNOWN THAT SUCH GOODS WERE STOLEN AND ANY LACK OF KNOWLEDGE IN THAT RESPECT WAS THE RESULT OF A SUBSTANTIAL AND UNJUSTIFIABLE RISK THAT HIS OR HER ACTIONS WOULD RESULT IN THE SALE OF STOLEN GOODS. FOSTERING THE SALE OF STOLEN GOODS IS A CLASS A MISDEMEANOR. § 2. This act shall take effect on the first of November next succeed- ing the date upon which it shall have become a law.
