BUTTENSCHON, EPSTEIN, HEVESI -- read once and referred to the Committee on Governmental Operations AN ACT to amend the executive law, in relation to establishing training and education practices for firefighters and first responders to protect and assist mobility limited and intellectually challenged individuals during an emergency situation THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Paragraph (u) of subdivision 2 of section 709 of the execu- tive law, as added by section 22 of part B of chapter 56 of the laws of 2010, is amended to read as follows: (u) Notwithstanding article six-C of this chapter, or any other provision of law to the contrary, the division of homeland security and emergency services shall establish best practices regarding training and education for firefighters and first responders which shall include but not be limited to: minimum basic training for firefighters and first responders; in-service training and continuing education; MINIMUM BASIC TRAINING TO PROVIDE FIREFIGHTERS AND FIRST RESPONDERS WITH THE PRACTICAL SKILLS AND TECHNIQUES NECESSARY TO PROTECT AND ASSIST BOTH MOBILITY LIMITED AND INTELLECTUALLY CHALLENGED INDIVIDUALS DURING AN EMERGENCY SITUATION; and specialized training as it may apply to the specific duties of a category of emergency personnel. § 2. Section 156 of the executive law is amended by adding a new subdivision 23 to read as follows: 23. IN ADDITION TO THE REQUIREMENTS OF SUBDIVISION TWENTY-TWO OF THIS SECTION, IN COORDINATION WITH THE COMMISSIONER OF THE OFFICE FOR PEOPLE WITH DEVELOPMENTAL DISABILITIES AND THE CHIEF DISABILITY OFFICER, PROVIDE MINIMUM BASIC TRAINING RELATED TO HANDLING EMERGENCY SITUATIONS INVOLVING INDIVIDUALS WITH ANY PHYSICAL AND/OR DEVELOPMENTAL DISABILITY TO ALL FIREFIGHTERS, BOTH PAID AND VOLUNTEER. THE OFFICE SHALL ADOPT ALL NECESSARY RULES AND REGULATIONS RELATING TO SUCH TRAINING. § 2. This act shall take effect immediately.
