ZINERMAN -- read once and referred to the Commit- tee on Codes AN ACT to amend the executive law, in relation to providing for the posting of firearm signage in certain areas THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. The executive law is amended by adding a new section 837-x to read as follows: § 837-X. REQUIREMENTS FOR FIREARM SIGNAGE. 1. THE DIVISION SHALL REVIEW AND COMPARE THE MOST RECENT NATIONAL GUN VIOLENCE STATISTICS, AS REPORTED BY THE NATIONAL CENTER FOR HEALTH STATISTICS, AGAINST THE MOST RECENT CRIMINAL JUSTICE STATISTICS CONCERNING GUN VIOLENCE AS COMPILED BY THE DIVISION, TO DETERMINE WHICH AREAS IN THE STATE EXPERIENCE A RATE OF GUN VIOLENCE ABOVE THE NATIONAL AVERAGE. FOR PURPOSES OF THIS SECTION, "AREA" SHALL BE DETERMINED BY THE DIVISION. 2. IN AREAS IN WHICH THE RATE OF GUN VIOLENCE IS ABOVE THE NATIONAL AVERAGE, THE DIVISION SHALL NOTIFY THE LAW ENFORCEMENT AGENCY SERVING SUCH AREA TO POST SIGNAGE IN THE FORM PRESCRIBED BY THE DIVISION. 3. STATISTICS REPORTED BY THE DIVISION AND THE NATIONAL CENTER FOR HEALTH STATISTICS SHALL BE REVIEWED ON A BIANNUAL BASIS BY THE DIVISION TO DETERMINE THE CONTINUED ACCURACY OF EXISTING SIGNAGE AND THE POTEN- TIAL NEED FOR ADDITIONAL SIGNAGE. 4. WHEN THE DIVISION DETERMINES THAT AN AREA'S SIGNAGE REQUIREMENTS HAVE CHANGED PURSUANT TO SUBDIVISION THREE OF THIS SECTION, THE DIVISION SHALL NOTIFY THE LAW ENFORCEMENT AGENCY SERVING SUCH AREA TO REMOVE OR INSTALL SUCH SIGNAGE AS NECESSARY. § 2. This act shall take effect on the one hundred eightieth day after it shall have become a law. Effective immediately, the addition, amend- ment and/or repeal of any rule or regulation necessary for the implemen- tation of this act on its effective date are authorized to be made and completed on or before such effective date.
