 AN  ACT in relation to requiring school districts to provide educational
   and support services to students with disabilities until such students
   turn twenty-three years of age
 
   THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section 1. Notwithstanding any provision of law, rule or regulation to
 the  contrary,  in  recognition  of  the  difficulties distance learning
 during the coronavirus  (COVID-19) pandemic poses to students with disa-
 bilities, and the educational opportunities for students with  disabili-
 ties  that  were  lost  or hampered, each New York school district shall
 provide educational and support services to students  with  disabilities
 in  special  education  programs  and  to pupils who are qualified hand-
 icapped persons as defined in the federal rehabilitation act of nineteen
 hundred seventy-three, as amended, in accordance with the student's most
 recent Individualized Education Program (IEP) until such  student  turns
 twenty-three  years of age for the school years 2019-2020, 2020-2021 and
 2021-2022.
   § 2. This act shall take effect immediately and  shall  apply  to  the
 2019-2020, 2020-2021 and 2021-2022 school years only.

   tional  services  until the student completes the services pursuant to
   the individualized education program or turns twenty-three years  old,
   whichever  is sooner; and to provide for the repeal of such provisions
   upon the expiration thereof
 
   THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section 1. Notwithstanding any provision of law, rule or regulation to
 the  contrary, a school district may provide educational services in the
 2023-24 and 2024-25 school years to  a  student  who  turned  twenty-one
 years  old during the 2022-23 school year and was enrolled in the school
 district and receiving special education services pursuant to  an  indi-
 vidualized  education program. Such student may continue to receive such
 educational services until the student completes the  services  pursuant
 to the individualized education program or turns twenty-three years old,
 whichever is sooner.
   §  2.  This  act shall take effect immediately and shall expire and be
 deemed repealed June 30, 2025.

 the  2024-25  school  year  to a student who turned twenty-one years old
 during the 2023-24 school year and was enrolled in the  school  district
 and  receiving  special education services pursuant to an individualized
 education program. Such student may continue to receive such educational
 services until the student completes the services pursuant to the  indi-
 vidualized  education program or the end of the school year during which
 the student turns twenty-two years old, whichever is sooner.
   § 2. This act shall take effect immediately and shall  expire  and  be
 deemed repealed June 30, 2025.
