S T A T E O F N E W Y O R K ________________________________________________________________________ 3129 2023-2024 Regular Sessions I N A S S E M B L Y February 2, 2023 ___________ Introduced by M. of A. RAJKUMAR -- read once and referred to the Commit- tee on Governmental Employees AN ACT to amend the administrative code of the city of New York, in relation to granting members of the city's police force eligibility for retirement and pension based on previous service as traffic enforcement agents THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. The administrative code of the city of New York is amended by adding a new section 13-633 to read as follows: § 13-633 TRANSFER OF MEMBERS OF THE NEW YORK CITY POLICE DEPARTMENT FROM TRAFFIC ENFORCEMENT TO THE POLICE FORCE. A. THE TIME SERVED AS A MEMBER OF THE CITY'S TRAFFIC ENFORCEMENT WHO HAS BECOME A MEMBER OF THE POLICE FORCE OF THE CITY, WHETHER BY TRANSFER OR AS A RESULT OF A COMPETITIVE EXAMINATION AND APPOINTMENT, AND WHO IS STILL A MEMBER OF THE POLICE FORCE OF THE CITY, SHALL BE INCLUDED AND COUNTED AS SERVICE IN THE POLICE FORCE FOR THE POLICE DEPARTMENT OF THE CITY IN DETERMINING RETIREMENT AND PENSION AS PROVIDED IN THIS CODE, PROVIDED, HOWEVER, THAT NO PERSON BECOMING A MEMBER OF THE POLICE DEPARTMENT OF THE CITY IN THE MANNER HEREIN PROVIDED, SHALL BE ENTITLED TO PARTICIPATE IN THE BENEFITS OF THE POLICE PENSION FUND, UNLESS HE OR SHE SHALL PAY INTO SUCH FUND THE TOTAL SUM THAT HE OR SHE WOULD HAVE BEEN REQUIRED TO PAY IN ORDER TO PARTICIPATE THEREIN HAD HE OR SHE BEEN A MEMBER OF SUCH FORCE FROM THE TIME HE OR SHE ENTERED THE SERVICE OF TRAFFIC ENFORCE- MENT. THESE PROVISIONS SHALL NOT BE SUBJECT TO ANY RESTRICTION RELATIVE TO TRANSFERS CONTAINED IN THE CIVIL SERVICE LAW OR IN THE RULES AND REGULATIONS OF THE CIVIL SERVICE COMMISSION OF THE STATE, OR ANY SUBDI- VISION THEREOF. B. NOTWITHSTANDING ANY OTHER PROVISIONS OF LAW, A MEMBER OF THE NEW YORK CITY POLICE DEPARTMENT SHALL BE ENTITLED TO BUY BACK AND RECEIVE SERVICE CREDIT FOR THE PERIOD OF TIME SUCH MEMBER WAS PREVIOUSLY EMPLOYED AS A NEW YORK CITY TRAFFIC ENFORCEMENT AGENT PURSUANT TO SUBDI- VISION A OF THIS SECTION. § 2. This act shall take effect immediately.

I am writing to express my strong support for Senate Bill #S5478, introduced by Senator Robert Jackson, and RAJKUMAR during the 2023-24 legislative session.
This bill holds significant importance to the dedicated members of the city of New York's police force. Specifically pecifically regarding their eligibility for retirement and pension based on previous service as traffic enforcement agents. As of March 6, The bill is currently in Cities 1 committee, and Assembly Committee awaiting further consideration.
In the upcoming voting session, I urge you to champion the cause of passing this bill into law and incorporating it into the Executive Budget. This initiative is not just about supporting our city workers. But also rectifying an inequity that exists in how different city agencies handle time transfer for their personnel. It's strikingly unfair that while other city agencies, have the privilege of having their time counted upfront. When transferring to the police force, previous traffic agents are deprived of this benefit, having their time counted only at the end of their service.
I would like to extend my heartfelt gratitude to Senator Robert Jackson and RAJKUMAR for there unwavering support in advancing this important legislation. Together with your support and that of our fellow senators, I believe we can rectify this discrepancy and ensure that all city workers, including previous traffic agents, receive fair treatment.
In conclusion, I wholeheartedly endorse Bill #S5478, and I kindly request your assistance in seeing it through to enactment. Thank you for your dedication to the well-being of our city's public servants and for your tireless efforts in improving the lives of the people you represent.
