EPSTEIN -- read once and referred to the Commit- tee on Governmental Operations AN ACT to amend the executive law, in relation to prohibiting members of law enforcement from using tear gas THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. The executive law is amended by adding a new section 170-g to read as follows: § 170-G. PROHIBITION OF THE USE OF TEAR GAS BY LAW ENFORCEMENT. INDI- VIDUALS EMPLOYED BY THE STATE OR A LOCAL MUNICIPALITY ACTING AS A POLICE OFFICER, PEACE OFFICER OR CORRECTION OFFICER SHALL BE PROHIBITED FROM USING TEAR GAS OR ANY ALTERNATE FORM OF TEAR GAS AT ANY TIME. § 2. This act shall take effect immediately. EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted. LBD07738-01-3
