Provides that when property, regardless of its nature and value, is taken from the person of another and the victim is 65 years of age or older or such property is obtained by extortion and the victim is 65 years of age or older, such crimes shall be grand larceny in the third degree and subject to a class D felony.

REILLY -- read once and referred to the Committee on Codes AN ACT to amend the penal law, in relation to grand larceny in the third degree of a person who is 65 years of age or older THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Section 155.35 of the penal law, as amended by chapter 464 of the laws of 2010, is amended to read as follows: § 155.35 Grand larceny in the third degree. A person is guilty of grand larceny in the third degree when he or she steals property and: 1. when the value of the property exceeds three thousand dollars[, or]; 2. the property is an automated teller machine or the contents of an automated teller machine[.]; 3. THE PROPERTY, REGARDLESS OF ITS NATURE AND VALUE, IS TAKEN FROM THE PERSON OF ANOTHER AND THE VICTIM IS 65 YEARS OF AGE OR OLDER; OR 4. THE PROPERTY, REGARDLESS OF ITS NATURE AND VALUE, IS OBTAINED BY EXTORTION AND THE VICTIM IS 65 YEARS OF AGE OR OLDER. Grand larceny in the third degree is a class D felony. § 2. This act shall take effect on the first of November next succeed- ing the date on which it shall have become a law. Subdivision 3 of 155.35 of the penal law, as added by section 5 of part O of chapter 56 of the laws of 2024, is amended to read as follows: 3. when such person commits deed theft of one commercial real proper- ty, regardless of the value[.], OR § 2. Section 155.35 of the penal law, as amended by section 5 of part O of chapter 56 of the laws of 2024, is amended by adding two new subdi- visions 4 and 5 to read as follows: 4. THE PROPERTY, REGARDLESS OF ITS NATURE AND VALUE, IS TAKEN FROM THE PERSON OF ANOTHER AND THE VICTIM IS SIXTY-FIVE YEARS OF AGE OR OLDER, OR 5. THE PROPERTY, REGARDLESS OF ITS NATURE AND VALUE, IS OBTAINED BY EXTORTION AS DEFINED IN SUBPARAGRAPHS (III), (IV), (V), (VI), (VII) AND (IX) OF PARAGRAPH (E) OF SUBDIVISION TWO OF SECTION 155.05 OF THIS CHAP- TER AND THE VICTIM IS SIXTY-FIVE YEARS OF AGE OR OLDER. § 3. This act shall take effect on the first of November next succeed- ing the date on which it shall have become a law; provided, however, that if section 5 of part O of chapter 56 of the laws of 2024 shall not have taken effect on or before such date then section one of this act shall take effect on the same date and in the same manner as such chap- ter of the laws of 2024 takes effect.
