AN ACT to amend the racing, pari-mutuel wagering and breeding law, in
relation to payments in support of racing
THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
BLY, DO ENACT AS FOLLOWS:
Section 1. Paragraph (b) of subdivision 2 of section 1355 of the
racing, pari-mutuel wagering and breeding law, as added by section 1 of
part LL of chapter 59 of the laws of 2021, is amended to read as
follows:
(b) Beginning on March sixteenth, two thousand twenty and for all time
thereafter, the licensee shall pay an amount to horsemen for purses at
the licensed racetracks in the region AND IN THE CASE OF REGION FIVE ANY
LICENSED RACETRACKS WITHIN SEVENTY-FIVE MILES OF THE LICENSEE'S FACILI-
TY, and an amount to the agricultural and New York state horse breeding
development fund and the New York state thoroughbred breeding and devel-
opment fund that, in aggregate, shall be equal to the product of three
and eight-tenths percent multiplied by the gross gaming revenue from
slot machines of the licensee for the applicable calendar year, provided
that such amount shall not exceed the amount paid by the licensee to
such horsemen and breeders funds for the full two thousand nineteen
calendar year adjusted annually by the lesser of (i) consumer price
index for all urban consumers, as published annually by the United
States department of labor bureau of labor statistics or (ii) two and
four-tenths percent. Of the amount paid pursuant to this paragraph,
eighty-seven percent will be paid to the horsemen and the remainder will
be paid to the agricultural and New York state horse breeding develop-
ment fund and the New York state thoroughbred breeding and development
fund.
§ 2. This act shall take effect immediately.
