NOVAKHOV, BROOK-KRASNY, FITZPATRICK, CHANG, PIROZZOLO -- read once and referred to the Committee on Environmental Conservation AN ACT to amend the environmental conservation law, in relation to certain actions being excluded from reporting requirements relating to environmental quality reviews THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Paragraphs (b) and (c) of subdivision 5 of section 8-0111 of the environmental conservation law, paragraph (b) as amended by section 1 of part BBB of chapter 55 of the laws of 2021 and paragraph (c) as amended by chapter 617 of the laws of 1987, are amended and a new paragraph (d) is added to read as follows: (b) Actions subject to the provisions requiring a certificate of envi- ronmental compatibility and public need in articles seven, ten and the former article eight of the public service law or requiring a siting permit under section ninety-four-c of the executive law; [or] (c) Actions subject to the class A or class B regional project juris- diction of the Adirondack park agency or a local government pursuant to section eight hundred seven, eight hundred eight or eight hundred nine of the executive law, except class B regional projects subject to review by local government pursuant to section eight hundred seven of the exec- utive law located within the Lake George park as defined by subdivision one of section 43-0103 of this chapter[.]; OR (D) ACTIONS TO APPROVE THE SITING OR CONSTRUCTION OF HOUSING IN CITIES WITH A POPULATION OF ONE MILLION OR MORE. § 2.
