 AN  ACT  to  amend  the  environmental  conservation law, in relation to
   prohibiting unlawful disposal of solid  waste  on  private  and  state
   property
 
   THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section 1. The environmental conservation law is amended by  adding  a
 new section 27-0720 to read as follows:
 § 27-0720. UNLAWFUL DISPOSAL OF SOLID WASTE.
   1.  NO  PERSON  MAY  KNOWINGLY  DISPOSE OF SOLID WASTE, BEYOND INITIAL
 COLLECTION, EXCEPT AT:
   (A) A DISPOSAL FACILITY EXEMPT FROM THE REQUIREMENTS OF 6 NYCRR 360.9;
 OR
   (B) A DISPOSAL FACILITY AUTHORIZED BY THE  DEPARTMENT  TO  ACCEPT  THE
 WASTE.
   2.  A VIOLATION OF SUBDIVISION ONE OF THIS SECTION SHALL BE PUNISHABLE
 BY A FINE OF NOT LESS THAN FIVE THOUSAND DOLLARS NOR  MORE  THAN  TWENTY
 THOUSAND  DOLLARS  PER  DAY OF VIOLATION OR BY IMPRISONMENT FOR NOT MORE
 THAN THIRTY DAYS OR BY BOTH SUCH FINE AND IMPRISONMENT.  SUCH  PENALTIES
 SHALL  BE  IMPOSED  IN  ADDITION  TO ANY PENALTIES IMPOSED UNDER SECTION
 71-2703 OF THIS ARTICLE.
   § 2. This act shall take effect immediately.
