SEAWRIGHT -- read once and referred to the Committee on People with Disabilities AN ACT to amend the mental hygiene law, in relation to permitting certain previous criminal history information provided to satisfy certain criminal background checks for certain employees THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Section 16.33 of the mental hygiene law is amended by adding a new subdivision (c) to read as follows: (C) WHERE THE DIVISION OF CRIMINAL JUSTICE SERVICES HAS PROVIDED CRIM- INAL HISTORY INFORMATION WITHIN THE PREVIOUS TWELVE MONTHS TO ANY STATE AGENCY FOR ANY INDIVIDUAL SUBJECT TO SUBDIVISION (A) OF THIS SECTION WHO IS A CURRENT EMPLOYEE OF THE OFFICE OR AN OFFICE-APPROVED PROVIDER, OF AN OFFICE OF CHILDREN AND FAMILY SERVICES LICENSED OR CERTIFIED PROGRAM, OF AN OFFICE OF ADDICTION SERVICES AND SUPPORTS CERTIFIED, FUNDED OR AUTHORIZED PROGRAM, OR OF AN OFFICE OF MENTAL HEALTH LICENSED, FUNDED OR APPROVED PROGRAM, SUCH INFORMATION SHALL BE USED TO SATISFY THE REQUIRE- MENTS OF THIS SECTION. § 2. This act shall take effect on the one hundred eightieth day after it shall have become a law. EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted.
