 AN  ACT in relation to directing the department of environmental conser-
   vation to develop and implement a tree planting pilot program  in  the
   ten  zip  codes in the state with the highest incidence of asthma; and
   making an appropriation therefor

   THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section  1.  Within  amounts  appropriated therefor, the department of
 environmental conservation shall develop and implement a  tree  planting
 pilot program in the state. The department of environmental conservation
 shall  consult  with  the  department of health to determine the ten zip
 codes in the state with the highest incidence of asthma. The  department
 of  environmental  conservation,  in  consultation  with local agencies,
 shall plant trees in such zip  codes  to  ameliorate  the  environmental
 conditions in those areas. Such pilot program shall continue for a peri-
 od  of  five  years  after the effective date of this act. At the end of
 such period, the department of environmental conservation, in  consulta-
 tion  with  the  department of health, shall report to the governor, the
 temporary president of the senate and the speaker of the assembly on the
 results of such pilot program and any  recommendations  for  legislative
 action.
   §  2. The sum of ten million dollars ($10,000,000), or so much thereof
 as may be necessary, is hereby appropriated to the department  of  envi-
 ronmental  conservation from the general fund, for implementation of the
 tree planting pilot program required by section one of this act.
   § 3. This act shall take effect April 1, 2024.
