CHANG -- read once and referred to the Committee on Governmental Operations AN ACT to amend the executive law, in relation to requiring the periodic inspection of commercial buildings where bicycles with electric assist are sold, rented, or stored for sale or rental THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Section 378 of the executive law is amended by adding a new subdivision 20 to read as follows: 20. STANDARDS FOR FIRE SAFETY INSPECTIONS OF COMMERCIAL BUILDINGS WHERE BICYCLES WITH ELECTRIC ASSIST ARE SOLD, RENTED, OR STORED FOR SALE OR RENTAL REQUIRING AN APPROPRIATE AND QUALIFIED INSPECTOR, AS DETER- MINED BY THE LOCAL GOVERNMENT, TO PERFORM A QUARTERLY FIRE SAFETY INSPECTION OF ANY COMMERCIAL BUILDING WHERE BICYCLES WITH ELECTRIC ASSIST ARE SOLD, RENTED, OR STORED FOR SALE OR RENTAL. THE COUNCIL SHALL ESTABLISH A REASONABLE FEE FOR SUCH INSPECTION WITHIN FORTY-FIVE DAYS OF THE EFFECTIVE DATE OF THIS SUBDIVISION. FOR THE PURPOSES OF THIS SUBDI- VISION, "BICYCLE WITH ELECTRIC ASSIST" SHALL HAVE THE SAME MEANING AS SECTION ONE HUNDRED TWO-C OF THE VEHICLE AND TRAFFIC LAW. § 2. STANDARDS FOR AFTER A FIRE-RELATED EMERGENCY OR OTHER FIRE-RELATED INCIDENT OCCURS IN A BUILDING WHERE BICYCLES WITH ELECTRIC ASSIST ARE REPAIRED, SOLD, RENTED, OR STORED FOR REPAIR, SALE OR RENTAL, REQUIRING NO BICYCLES WITH ELECTRIC ASSIST BE STORED ON THE PREMISES FOR ANY PURPOSE UNTIL THE PREMISES HAVE BEEN INSPECTED AND DETERMINED TO BE IN COMPLIANCE WITH ALL RELEVANT LAWS AND REGULATIONS BY AN APPROPRIATE AND QUALIFIED INSPECTOR AS DETERMINED BY THE LOCAL GOVERNMENT. § 2. This act shall take effect on the sixtieth day after it shall have become a law. EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets
