 AN  ACT  to  amend the executive law, in relation to requiring standards
   for the new construction of  electric  vehicle  charging  stations  to
   require such stations to have an external automatic cutoff switch

   THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section 1. Section 378 of the executive law is amended by adding a new
 subdivision 21 to read as follows:
   21. STANDARDS REQUIRING NEW CONSTRUCTION OF ELECTRIC VEHICLE,  INCLUD-
 ING  BICYCLES  WITH  ELECTRIC  ASSIST  AND  ELECTRIC  SCOOTERS, CHARGING
 STATIONS TO INCLUDE AN EXTERNAL AUTOMATIC CUTOFF SWITCH.   AN  AUTOMATIC
 CUTOFF  SWITCH  SHALL  BE  A  HAND-OPERATED  SWITCH  WHICH IS CAPABLE OF
 CUTTING OFF ALL POWER AND ELECTRICITY TO THE VEHICLE, BICYCLE OR SCOOTER
 WITHOUT THE NEED OF A KEY OR TO UNLOCK  THE  DEVICE.    FOR  RESIDENTIAL
 ELECTRIC  VEHICLE  CHARGING STATIONS, SUCH CUTOFF SWITCH SHALL BE PLACED
 OUTSIDE OF THE HOUSE OR GARAGE.  FOR BICYCLES WITH ELECTRIC  ASSIST  AND
 ELECTRIC SCOOTERS, SUCH CUTOFF SWITCH SHALL BE LOCATED ON THE OUTSIDE OF
 THE PHYSICAL CHARGING DEVICE AND SHALL BE EASILY ACCESSIBLE.
   § 2. This act shall take effect immediately.

 AN ACT to amend the executive law, in relation  to  requiring  standards
   for  the  new  construction  of  electric vehicle charging stations to
   require such stations to have an external cutoff switch
 
   THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section  1.  Subdivision  20  of  section 378 of the executive law, as
 renumbered by section 3 of part RR of chapter 56 of the laws of 2023, is
 renumbered subdivision 21 and a new subdivision 20 is added to  read  as
 follows:
   20.  STANDARDS  REQUIRING  NEW  CONSTRUCTION  OF PERMANENTLY INSTALLED
 RESIDENTIAL ELECTRIC VEHICLE CHARGING STATIONS TO INCLUDE A RED EXTERNAL
 CUTOFF SWITCH, A SIGN WITH DIRECTIONS TO THE  RESIDENCE'S  BREAKER  BOX,
 AND  A  BRIGHTLY  LABELED  STICKER PLACED ON THE RESIDENCE'S BREAKER BOX
 NEXT TO THE SWITCH THAT CUTS POWER  TO  THE  ELECTRIC  VEHICLE  CHARGING
 STATION. SUCH REQUIREMENTS SHALL ALSO APPLY TO THE SALE OR TRANSFER OF A
 RESIDENCE  CONTAINING  A PERMANENTLY INSTALLED ELECTRIC VEHICLE CHARGING
 STATION.  A CUTOFF SWITCH SHALL BE A HAND-OPERATED SWITCH WHICH IS CAPA-
 BLE OF CUTTING OFF ALL POWER AND ELECTRICITY TO THE VEHICLE WITHOUT  THE
 NEED  OF A KEY OR TO UNLOCK THE DEVICE.  FOR PERMANENTLY INSTALLED RESI-
 DENTIAL ELECTRIC VEHICLE CHARGING STATIONS, SUCH CUTOFF SWITCH SHALL  BE
 PLACED OUTSIDE OF THE HOUSE OR GARAGE.
   § 2. This act shall take effect immediately.
