Expands Medicaid coverage to include abortion services and travel-related expenses uncovered by the military for active duty members of the armed forces of the United States, or their spouses or dependents, who are New York state residents; provides such travel-related expenses include those for such members, or their spouses or dependents, located within another state or a foreign country where they could not legally receive such services due to such active duty status.

 AN ACT to amend the social services law, in relation to expanding  Medi-
   caid coverage to include abortion services and travel-related expenses
   uncovered by the military for certain New York state residents

   THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section 1. Subdivision 2 of section 365-a of the social  services  law
 is amended by adding a new paragraph (mm) to read as follows:
   (MM)   ABORTION   SERVICES,   INCLUDING  SURGICAL  AND  PHARMACEUTICAL
 ABORTIONS, AND ANY NECESSARY TRAVEL-RELATED EXPENSES INCURRED TO RECEIVE
 SUCH SERVICES DUE TO THE RECIPIENT OF SUCH SERVICES BEING LOCATED WITHIN
 ANOTHER STATE OR A FOREIGN COUNTRY WHERE SUCH SERVICES COULD NOT LEGALLY
 BE OBTAINED, WHICH ARE NOT COVERED BY ANY OTHER INSURANCE OR  THE  ARMED
 FORCES OF THE UNITED STATES, WHEN:
   (I) SUCH SERVICES ARE PROVIDED BY A HEALTH CARE PRACTITIONER LICENSED,
 CERTIFIED,  OR AUTHORIZED UNDER TITLE EIGHT OF THE EDUCATION LAW, ACTING
 WITHIN HIS OR HER LAWFUL SCOPE OF PRACTICE; AND
   (II) SUCH SERVICES ARE PROVIDED TO A RESIDENT OF THE STATE WHO  IS  AN
 ACTIVE DUTY MEMBER OF THE ARMED FORCES OF THE UNITED STATES, OR WHO IS A
 SPOUSE OR DEPENDENT OF SUCH MEMBER.
   § 2. This act shall take effect on the one hundred eightieth day after
 it  shall have become a law. Effective immediately, the addition, amend-
 ment and/or repeal of any rule or regulation necessary for the implemen-
 tation of this act on its effective date are authorized to be  made  and
 completed on or before such effective date.
