SAYEGH -- read once and referred to the Committee on Consumer Affairs and Protection AN ACT to amend the public service law and the public authorities law, in relation to requiring the results of any outage management system stress test conducted in the state by a utility company to be posted online THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. The public service law is amended by adding a new section 54 to read as follows: § 54. UTILITY OUTAGE MANAGEMENT SYSTEM STRESS TESTING. 1. FOR PURPOSES OF THIS SECTION, "OUTAGE MANAGEMENT SYSTEM STRESS TEST" SHALL MEAN A TEST CONDUCTED BY A UTILITY TO DETERMINE THE ABILITY OF SUCH UTILITY TO HANDLE AND RESPOND TO LARGE SCALE WEATHER EVENTS OR NATURAL DISASTERS THAT ARE LIKELY TO RESULT IN THE LOSS OF SERVICE TO CUSTOMERS. 2. (A) THE DEPARTMENT SHALL POST THE RESULTS OF ANY OUTAGE MANAGEMENT SYSTEM STRESS TEST CONDUCTED IN THE STATE BY A UTILITY CORPORATION, WATER MUNICIPALITY OR LOCAL PUBLICLY OWNED ELECTRIC OR GAS CORPORATION ON THE DEPARTMENT'S WEBSITE AS SOON AS SUCH RESULTS BECOME AVAILABLE. (B) THE COMMISSIONER SHALL ALSO SUBMIT A REPORT OF SUCH RESULTS TO THE TEMPORARY PRESIDENT OF THE SENATE, THE SPEAKER OF THE ASSEMBLY AND THE CHAIRS OF THE SENATE AND ASSEMBLY STANDING COMMITTEES ON ENERGY. § 2. Title 1-A of article 5 of the public authorities law, as added by chapter 517 of the laws of 1986, is amended by adding a new section 1020-nn to read as follows: § 1020-NN. OUTAGE MANAGEMENT SYSTEM STRESS TESTING. 1. FOR PURPOSES OF THIS SECTION, "OUTAGE MANAGEMENT SYSTEM STRESS TEST" SHALL MEAN A TEST CONDUCTED BY THE AUTHORITY OR A SERVICE PROVIDER TO DETERMINE THE ABILITY OF THE AUTHORITY OR SUCH SERVICE PROVIDER TO HANDLE AND RESPOND EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted.
