E. BROWN -- read once and referred to the Commit- tee on Governmental Employees AN ACT to amend the civil service law, the public officers law and the general municipal law, in relation to the employment by and funding of the Nassau county public library system THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Legislative intent. This act seeks to enhance civil service exemptions for library employees in the state of New York, recognizing the unique challenges and contributions of libraries within their commu- nities. It aims to provide greater flexibility in hiring, fair compen- sation, and equitable funding for libraries. § 2. The civil service law is amended by adding a new section 61-a to read as follows: § 61-A. APPOINTMENT AND PROMOTION; NASSAU COUNTY PUBLIC LIBRARY SYSTEM. NOTWITHSTANDING THE PROVISIONS OF SECTION FIFTY-ONE OF THIS ARTICLE OR SECTION SIXTY-ONE OF THIS TITLE, THE NASSAU COUNTY PUBLIC LIBRARY SYSTEM IS AUTHORIZED TO APPOINT OR PROMOTE FROM AN ELIGIBLE LIST TO A POSITION IN THE COMPETITIVE CLASS BY THE SELECTION OF ONE OF THE FIVE PERSONS CERTIFIED BY THE APPROPRIATE CIVIL SERVICE COMMISSION AS STANDING HIGHEST ON SUCH ELIGIBLE LIST WHO ARE WILLING TO ACCEPT SUCH APPOINTMENT OR PROMOTION. § 3. Section 3 of the public officers law is amended by adding a new subdivision 74 to read as follows: 74. IN THE COUNTY OF NASSAU, THE PROVISIONS OF THIS SECTION REQUIRING A PERSON TO BE A RESIDENT OF THE POLITICAL SUBDIVISION OR MUNICIPAL CORPORATION OF THE STATE FOR WHICH HE OR SHE SHALL BE EMPLOYED OR WITHIN WHICH HIS OR HER OFFICIAL FUNCTIONS ARE REQUIRED TO BE EXERCISED, SHALL NOT PREVENT A PERSON FROM HOLDING THE OFFICE OF NASSAU COUNTY PUBLIC LIBRARY SYSTEM EMPLOYEE, PROVIDED THAT SUCH PERSON RESIDES WITHIN THE STATE OF NEW YORK.
