   HAWLEY,  JENSEN, LEMONDES, MAHER, MANKTELOW, McDONOUGH, MCGOWAN, MIKU-
   LIN, MILLER, MORINELLO, NORRIS, NOVAKHOV, PIROZZOLO, RA, REILLY, SIMP-
   SON, SLATER, SMITH, SMULLEN, TAGUE, TANNOUSIS, WALSH -- read once  and
   referred to the Committee on Environmental Conservation
 
 AN  ACT  to  amend  the public authorities law, in relation to requiring
   that any rules or regulations promulgated by the department  of  envi-
   ronmental conservation pursuant to the climate action fund are subject
   to a vote of the legislature for approval
 
   THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section 1. Section 1854 of the public authorities law  is  amended  by
 adding two new subdivisions 27 and 28 to read as follows:
   27. ALL RULES OR REGULATIONS PROMULGATED PURSUANT TO SUBDIVISION TWEN-
 TY-FOUR,  TWENTY-FIVE  OR TWENTY-SIX OF THIS SECTION SHALL BE SUBJECT TO
 APPROVAL BY A MAJORITY VOTE OF THE LEGISLATURE PRIOR TO IMPLEMENTATION.
   28. PURSUANT TO THE CLIMATE AFFORDABILITY STUDY DESCRIBED IN  SUBDIVI-
 SION  TWENTY-SIX  OF  THIS  SECTION, NO RECOMMENDATION GENERATED BY SUCH
 STUDY SHALL TAKE EFFECT, AND NO MONIES SHALL BE DEPOSITED  INTO  ANY  OF
 THE  ACCOUNTS  DESCRIBED  IN SUBDIVISIONS TWENTY-FOUR AND TWENTY-FIVE OF
 THIS SECTION, PRIOR TO APPROVAL BY A MAJORITY VOTE OF THE LEGISLATURE.
   § 2.  This act shall take effect immediately.
