S T A T E O F N E W Y O R K ________________________________________________________________________ 8272 2023-2024 Regular Sessions I N A S S E M B L Y November 27, 2023 ___________ Introduced by M. of A. FAHY -- read once and referred to the Committee on Transportation AN ACT to amend the vehicle and traffic law, in relation to clarifying that all trail users, including bicyclists, have right of way in crosswalks wherever the multi-use trail crosses a roadway THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Section 1151 of the vehicle and traffic law, is amended by adding a new subdivision (d) to read as follows: (D) WHEREVER A MULTI-USE TRAIL CROSSES A ROADWAY, A VEHICLE SHALL YIELD THE RIGHT OF WAY TO ANY USER OF SUCH MULTI-USE TRAIL CROSSING SUCH ROADWAY WITHIN A CROSSWALK ON SUCH ROADWAY UPON WHICH SUCH VEHICLE IS TRAVELING. ANY USER OF A MULTI-USE TRAIL, INCLUDING A BICYCLIST, SHALL BE SUBJECT TO THE SAME LIMITATIONS PLACED ON PEDESTRIANS PURSUANT TO THIS SECTION FOR THE PURPOSES OF CROSSING A ROADWAY IN A CROSSWALK THAT IS CONTIGUOUS TO SUCH MULTI-USE TRAIL. FOR THE PURPOSES OF THIS SUBDIVI- SION, THE TERM "MULTI-USE TRAIL" SHALL MEAN A TRAIL ESTABLISHED PURSUANT TO SECTION TWENTY-TWO OF THE HIGHWAY LAW BY THE DEPARTMENT OF TRANSPOR- TATION OR ESTABLISHED BY THE OFFICE OF PARKS, RECREATION AND HISTORIC PRESERVATION, THE DEPARTMENT OF ENVIRONMENTAL CONSERVATION, THE NEW YORK STATE CANAL CORPORATION, THE HUDSON RIVER VALLEY GREENWAY, OR ANY OTHER STATE AGENCY OR AN AFFILIATE OR SUBSIDIARY OF A STATE AGENCY, OR A COUN- TY, CITY, TOWN, VILLAGE, OR PRIVATE ENTITY FOR RECREATION AND TRANSPOR- TATION USE BY PEDESTRIANS, BICYCLISTS, AND/OR OTHERS UTILIZING NON-MO- TORIZED TRANSPORT. § 2.
