 AN  ACT  to  amend the vehicle and traffic law, in relation to requiring
   businesses that provide delivery services  provide  markings  on  both
   their motor vehicles and drivers that identify them as such

   THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section 1. The vehicle and traffic law is  amended  by  adding  a  new
 section 1229-e to read as follows:
   § 1229-E. IDENTIFICATION OF DELIVERY VEHICLES AND DRIVERS.  1. FOR THE
 PURPOSES  OF THIS SECTION "CARRIER" SHALL MEAN ANY BUSINESS, FIRM, PART-
 NERSHIP, ASSOCIATION, LIMITED LIABILITY COMPANY, CORPORATION,  CONTRACT-
 ING  AGENCY  OR OTHER ENTITY LICENSED TO DO BUSINESS IN THE STATE OF NEW
 YORK.
   2. IT SHALL BE THE  DUTY  OF  EVERY  CARRIER  THAT  PROVIDES  DELIVERY
 SERVICES VIA MOTOR VEHICLE TO COMPLY WITH ONE OR MORE OF THE FOLLOWING:
   (A)  A CLEARLY VISIBLE GRAPHIC ASSOCIATED WITH SUCH CARRIER AFFIXED TO
 BOTH SIDE PANELS ON THE VEHICLE;
   (B) A CLEARLY VISIBLE TEXT LETTERING WITH SUCH CARRIER NAME  AT  LEAST
 FOUR INCHES IN HEIGHT ON BOTH SIDE PANELS OF THE VEHICLE; OR
   (C)  A  WHITE  SIGN ON BOTH SIDE PANELS ON SUCH VEHICLE CONTAINING THE
 FOLLOWING STATEMENT: "DELIVERY VEHICLE".
   3. IT SHALL BE THE DUTY OF EVERY OPERATOR OF SUCH  VEHICLE  TO  COMPLY
 WITH ONE OR MORE OF THE FOLLOWING:
   (A) A UNIFORM ISSUED BY THE OPERATOR'S EMPLOYER OR CONTRACTING AGENCY;
   (B)  A  BADGE  THAT  IS  CLEARLY VISIBLE AND ISSUED BY SUCH OPERATOR'S
 EMPLOYER OR CONTRACTING AGENCY; OR
   (C) A NEON VEST THAT CONTAINS TEXT AT LEAST FOUR INCHES IN HEIGHT WITH
 FOLLOWING STATEMENT: "PACKAGE CARRIER".
