S T A T E O F N E W Y O R K ________________________________________________________________________ 9021 I N A S S E M B L Y February 5, 2024 ___________ Introduced by M. of A. PHEFFER AMATO -- read once and referred to the Committee on Local Governments AN ACT to amend the general municipal law, in relation to disabilities of sanitation department employees caused by leptospirosis THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. The general municipal law is amended by adding a new section 207-aa to read as follows: § 207-AA. DISABILITIES OF MEMBERS OF THE UNIFORMED FORCE OF SANITATION DEPARTMENTS CAUSED BY LEPTOSPIROSIS. 1. NOTWITHSTANDING THE PROVISIONS OF ANY GENERAL, SPECIAL, OR LOCAL LAW TO THE CONTRARY, ANY CONDITION OF IMPAIRMENT OF HEALTH CAUSED BY LEPTOSPIROSIS THAT RESULTS IN TOTAL OR PARTIAL DISABILITY OR DEATH TO A PAID MEMBER OF THE UNIFORMED FORCE OF A SANITATION DEPARTMENT, WHERE SUCH MEMBER IS DRAWN FROM COMPETITIVE CIVIL SERVICE LISTS AND SUCCESSFULLY PASSED A PHYSICAL EXAMINATION UPON ENTRY INTO THE SERVICE OF SUCH SANITATION DEPARTMENT, AND SUCH EXAMINATION FAILED TO REVEAL ANY EVIDENCE OF SUCH CONDITION, SHALL BE PRESUMPTIVE EVIDENCE THAT SUCH CONDITION WAS INCURRED IN THE PERFORMANCE AND DISCHARGE OF SUCH MEMBER'S DUTY, UNLESS COMPETENT EVIDENCE PROVES OTHER- WISE. 2. THE PROVISIONS OF THIS SECTION SHALL NOT APPLY TO THE WORKERS' COMPENSATION LAW AND THE LABOR LAW. § 2. This act shall take effect immediately.
