 AN  ACT  to amend the public health law, in relation to hospital compli-
   ance with federal hospital price transparency law and rules
 
   THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
 BLY, DO ENACT AS FOLLOWS:

   Section  1. Section 2805 of the public health law is amended by adding
 a new subdivision 3 to read as follows:
   3. (A) THE COMMISSIONER SHALL REPORT MONTHLY  ON  HOSPITAL  COMPLIANCE
 WITH  FEDERAL  HOSPITAL  PRICE  TRANSPARENCY LAW, RULES AND REGULATIONS.
 SUCH REPORT SHALL BE CONSPICUOUSLY POSTED ON THE DEPARTMENT'S WEBSITE.
   (B) EFFECTIVE APRIL FIRST, TWO  THOUSAND  TWENTY-FIVE,  NO    HOSPITAL
 SHALL  ACCESS ANY FUNDS PURSUANT TO SECTION TWENTY-EIGHT HUNDRED SEVEN-K
 OF THIS ARTICLE IF THEY ARE NOT  IN  MATERIAL  COMPLIANCE  WITH  FEDERAL
 HOSPITAL PRICE TRANSPARENCY LAW, RULES AND REGULATIONS.  THE COMMISSION-
 ER MAY ALLOW CONTINUED ACCESS TO THE FUND IF SUCH COMMISSIONER DEEMS THE
 FACILITY ESSENTIAL AND IS MAKING PROGRESS TOWARDS COMPLIANCE WITH FEDER-
 AL HOSPITAL PRICE TRANSPARENCY LAW, RULES AND REGULATIONS. SUCH DETERMI-
 NATION SHALL BE MADE ON A YEARLY BASIS.
   § 2. This act shall take effect on the one hundred eightieth day after
 it  shall have become a law. Effective immediately, the addition, amend-
 ment and/or repeal of any rule or regulation necessary for the implemen-
 tation of this act on its effective date are authorized to be  made  and
 completed on or before such effective date.

 AN ACT to amend the public health law, in relation to  hospital  compli-
   ance  with  federal  hospital  price transparency law, rules and regu-
   lations

   THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section  1. Section 2805 of the public health law is amended by adding
 a new subdivision 3 to read as follows:
   3.  THE COMMISSIONER SHALL REPORT  QUARTERLY  ON  HOSPITAL  COMPLIANCE
 WITH  FEDERAL  HOSPITAL  PRICE  TRANSPARENCY LAW, RULES AND REGULATIONS.
 SUCH REPORT SHALL BE CONSPICUOUSLY POSTED ON THE DEPARTMENT'S WEBSITE.
   § 2. Hospitals not in compliance with federal price transparency  law,
 rules  and regulations shall be subject to penalties under section 12 of
 the public health law.
   § 3. This act shall take effect on the  one  hundredth  day  after  it
