 AN ACT to amend the general business law, in relation  to  the  sale  of
   bicycles with electric assist and electric scooters
 
   THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
 BLY, DO ENACT AS FOLLOWS:

   Section 1. The general business law is amended by adding a new section
 391-cc to read as follows:
   § 391-CC. SALE OF BICYCLES WITH ELECTRIC ASSIST AND ELECTRIC SCOOTERS.
 1. FOR THE PURPOSES OF THIS SECTION, THE FOLLOWING TERMS SHALL HAVE  THE
 FOLLOWING MEANINGS:
   (A)  "BICYCLE  WITH  ELECTRIC  ASSIST"  SHALL HAVE THE SAME MEANING AS
 DEFINED BY SECTION ONE HUNDRED TWO-C OF THE VEHICLE AND TRAFFIC LAW.
   (B) "ELECTRIC SCOOTER" SHALL HAVE  THE  SAME  MEANING  AS  DEFINED  BY
 SECTION ONE HUNDRED FOURTEEN-E OF THE VEHICLE AND TRAFFIC LAW.
   (C)  "FIREPROOF  BATTERY CONTAINER" SHALL MEAN A BAG, BOX, BLANKET, OR
 OTHER MEANS OF CONTAINING OR COVERING A BATTERY USED  AS  THE  PRINCIPAL
 ELECTRIC  POWER  SOURCE  FOR  A BICYCLE WITH ELECTRIC ASSIST OR ELECTRIC
 SCOOTER THAT IS CAPABLE OF RESISTING THE EFFECT OF FIRE  INVOLVING  SUCH
 BATTERIES  AND  MEETS  ALL  MINIMUM  SPECIFICATIONS AS DETERMINED BY THE
 DIVISION OF HOMELAND SECURITY AND EMERGENCY SERVICES PURSUANT TO  SUBDI-
 VISION THREE OF THIS SECTION.
   2. NO PERSON, FIRM, PARTNERSHIP, ASSOCIATION, LIMITED LIABILITY COMPA-
 NY,  CORPORATION,  OR OTHER ENTITY SHALL SELL OR OFFER TO SELL A BICYCLE
 WITH ELECTRIC ASSIST OR ELECTRIC SCOOTER TO A CONSUMER UNLESS SUCH BICY-
 CLE WITH ELECTRIC ASSIST OR ELECTRIC SCOOTER IS SOLD  WITH  A  FIREPROOF
 BATTERY  CONTAINER FOR THE SAFE STORAGE OF THE BATTERY USED AS THE PRIN-
 CIPAL ELECTRIC POWER SOURCE.
   3. THE DIVISION OF HOMELAND  SECURITY  AND  EMERGENCY  SERVICES  SHALL
 DETERMINE THE MINIMUM SPECIFICATIONS AND PERFORMANCE STANDARDS FOR FIRE-
 PROOF BATTERY CONTAINERS UNDER THIS SECTION.
   4.  A  VIOLATION  OF THIS SECTION SHALL BE PUNISHABLE BY A FINE OF TWO
 HUNDRED FIFTY DOLLARS FOR A FIRST VIOLATION, AND  FIVE  HUNDRED  DOLLARS
 FOR EACH SUBSEQUENT VIOLATION.
