S T A T E O F N E W Y O R K ________________________________________________________________________ 9853 I N A S S E M B L Y April 24, 2024 ___________ Introduced by M. of A. BURDICK -- read once and referred to the Commit- tee on Environmental Conservation AN ACT to amend the public authorities law, in relation to authorizing the New York state environmental facilities corporation to award grants and loans to non-public entities for certain water quality projects THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Subdivision 2 of section 1283 of the public authorities law, as amended by chapter 744 of the laws of 1970, is amended to read as follows: 2. FOR THE PURPOSES OF THIS SECTION, "PERFLUOROALKYL AND POLYFLUORO- ALKYL SUBSTANCES" OR "PFAS" SHALL HAVE THE SAME MEANING AS IN SECTION 37-0203 OF THE ENVIRONMENTAL CONSERVATION LAW. 3. THE CORPORATION MAY AWARD GRANTS AND LOANS TO NON-PUBLIC ENTITIES FOR WATER QUALITY PROJECTS THAT RELATE TO THE REMOVAL OF PERFLUOROALKYL AND POLYFLUOROALKYL SUBSTANCES (PFAS) FOR A PUBLIC WATER SYSTEM WHICH PROVIDES WATER TO THE PUBLIC FOR HUMAN CONSUMPTION THROUGH PIPES OR OTHER CONSTRUCTED CONVEYANCES. FOR PURPOSES OF THIS SUBDIVISION, "PUBLIC WATER SYSTEM" MEANS A PUBLIC WATER SYSTEM AS DEFINED IN 10 NYCRR 5-1.1(CB) AND INCLUDES A COMMUNITY WATER SYSTEM, NONCOMMUNITY WATER SYSTEM, TRANSIENT NONCOMMUNITY WATER SYSTEM, NONTRANSIENT NONCOMMUNITY WATER SYSTEM AS DEFINED IN SUCH REGULATIONS AND ANY SUBSEQUENT UPDATES OF SUCH REGULATIONS BY THE DEPARTMENT OF HEALTH. 4. It is hereby found and declared that such purposes are in all respects for the benefit of the people of the state of New York and the corporation shall be regarded as performing an essential governmental function in carrying out its purposes and in exercising the powers granted by this title. § 2.
