S T A T E O F N E W Y O R K ________________________________________________________________________ 9982 I N A S S E M B L Y May 1, 2024 ___________ Introduced by M. of A. JACKSON -- read once and referred to the Commit- tee on Health AN ACT to amend the public health law, in relation to requiring certain locations and venues maintain a supply of opioid antagonists THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Subdivision 8 of section 3309 of the public health law, as added by chapter 83 of the laws of 2023, is amended to read as follows: 8. The commissioner shall establish guidelines for onsite opioid over- dose response capacity in nightlife establishments, SPORTING OR EVENT CENTERS, THEATERS, CONCERT VENUES, AND AMUSEMENT PARKS. SUCH GUIDELINES SHALL INCLUDE, BUT SHALL NOT BE LIMITED TO: (A) MAINTAINING A SUPPLY OF UNEXPIRED OPIOID ANTAGONIST NASAL SPRAY; AND (B) HAVING EMPLOYED AND AT SUCH LOCATION WHENEVER IN OPERATION AT LEAST TWO PERSONS TRAINED IN IDENTIFYING OPIOID OVERDOSES AND USING OPIOID ANTAGONISTS. § 2. This act shall take effect on the ninetieth day after it shall have become a law. EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted. LBD14868-01-4
