BILL NUMBER: S1013 SPONSOR: COONEY TITLE OF BILL: An act to amend the criminal procedure law, in relation to designating as peace officers certain employees of the Monroe county sheriff's office serving as court security deputies at Monroe county court facili- ties PURPOSE OR GENERAL IDEA OF BILL: Provides peace officer status to court security deputies, employed by the Monroe County Sheriff's Department at Monroe County court facili- ties. SUMMARY OF SPECIFIC PROVISIONS: Section 1. Section 2.10 of the criminal procedure law is amended by adding a new subdivision 86 to allow a deputy sheriff who is employed by the sheriff's department of Monroe county to perform the delivery of security services to the courts.

Section 2.10 of the criminal procedure law is amended by adding a new subdivision 86 to read as follows: 86. PERSONS EMPLOYED BY THE MONROE COUNTY SHERIFF'S OFFICE SERVING AS COURT SECURITY DEPUTIES AT MONROE COUNTY COURT FACILITIES; PROVIDED, HOWEVER, THAT NOTHING IN THIS SUBDIVISION SHALL BE DEEMED TO AUTHORIZE SUCH OFFICER TO CARRY, POSSESS, REPAIR OR DISPOSE OF A FIREARM UNLESS THE APPROPRIATE LICENSE THEREFOR HAS BEEN ISSUED PURSUANT TO SECTION 400.00 OF THE PENAL LAW. § 2. This act shall take effect on the thirtieth day after it shall have become a law. EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted. LBD01790-01-3
