BILL NUMBER: S1031 SPONSOR: JACKSON TITLE OF BILL: An act to amend the election law, in relation to the definition of party PURPOSE: The purpose of this legislation is to return to the original definition of "party" so that smaller parties may have a place on general election ballots and that voters will have freedom to choose a party that best aligns with their political views. SUMMARY OF PROVISIONS: Section 1 amends subdivision 3 of Section 1-104 of the Election Law to define "party" as any political organization which at the last preceding election for governor polled at least fifty thousand votes for its candidate for governor. Section 2 is the effective date.

JACKSON, SANDERS -- read twice and ordered printed, and when printed to be committed to the Committee on Elections AN ACT to amend the election law, in relation to the definition of party THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Subdivision 3 of section 1-104 of the election law, as amended by section 10 of part ZZZ of chapter 58 of the laws of 2020, is amended to read as follows: 3. The term "party" means any political organization which[, excluding blank and void ballots, at the last preceding election for governor received, at least two percent of the total votes cast for its candidate for governor, or one hundred thirty thousand votes, whichever is great- er, in the year in which a governor is elected and at least two percent of the total votes cast for its candidate for president, or one hundred thirty thousand votes, whichever is greater, in a year when a president is elected] AT THE LAST PRECEDING ELECTION FOR GOVERNOR POLLED AT LEAST FIFTY THOUSAND VOTES FOR ITS CANDIDATE FOR GOVERNOR. § 2.
