BILL NUMBER: S1143 SPONSOR: SKOUFIS TITLE OF BILL: An act to amend the economic development law, in relation to the eligi- bility criteria for the excelsior jobs program act PURPOSE: This bill is to amend the economic development law for the surrender of all previous state subsidies issued to a business entity which is found to have violated any worker protection and environmental laws and regu- lations. SUMMARY OF PROVISIONS: Section 1: Amends subdivision 6 of section 353 of the economic develop- ment law for the surrender of all previous state subsidies issued to a business entity which is found to have violated any worker protection and environmental laws and regulations.

SKOUFIS -- read twice and ordered printed, and when printed to be committed to the Committee on Commerce, Economic Devel- opment and Small Business AN ACT to amend the economic development law, in relation to the eligi- bility criteria for the excelsior jobs program act THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Subdivision 6 of section 353 of the economic development law, as amended by section 2 of part G of chapter 61 of the laws of 2011, is amended to read as follows: 6. A business entity must be in compliance with all worker protection and environmental laws and regulations. In addition, a business entity may not owe past due state taxes or local property taxes. IN THE EVENT THAT A BUSINESS ENTITY IS FOUND TO HAVE VIOLATED SUCH WORKER PROTECTION OR ENVIRONMENTAL LAWS AND REGULATIONS, PENDING A FULL AUDIT BY THE STATE COMPTROLLER, THE STATE SHALL ORDER THE SURRENDER OF ALL PREVIOUS STATE SUBSIDIES ISSUED TO SUCH BUSINESS ENTITY. § 2.
