BILL NUMBER: S1795 SPONSOR: HINCHEY TITLE OF BILL: An act to amend the environmental conservation law, in relation to requiring the department of environmental conservation to develop and propose an appropriation to fund the charge New York drive clean rebate program PURPOSE: To make more accessible the ability to purchase electric vehicles by increasing funding for the charge New York drive clean rebate program. HINCHEY -- read twice and ordered printed, and when printed to be committed to the Committee on Environmental Conservation AN ACT to amend the environmental conservation law, in relation to requiring the department of environmental conservation to develop and propose an appropriation to fund the charge New York drive clean rebate program THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Subdivision 2 of section 19-0306-b of the environmental conservation law is amended by adding a new paragraph d to read as follows: D. AN APPROPRIATION TO FUND THE CHARGE NEW YORK DRIVE CLEAN REBATE PROGRAM. SUCH APPROPRIATION SHALL BE NO LESS THAN FIFTY MILLION DOLLARS PER FISCAL YEAR, AND SUCH APPROPRIATION SHALL REMAIN IN EFFECT AT LEAST UNTIL THE YEAR TWO THOUSAND TWENTY-EIGHT. THE DEPARTMENT, IN CONSULTA- TION WITH THE NEW YORK STATE ENERGY RESEARCH AND DEVELOPMENT AUTHORITY AND OTHER INTERESTED PARTIES, SHALL MEANS TEST THE APPROPRIATION. THE UPPER LIMIT OF SUCH A MEANS TEST SHALL NOT EXCEED SIXTY-FIVE THOUSAND DOLLARS IN NET INCOME FOR A SINGLE TAX FILER AND ONE HUNDRED THIRTY THOUSAND DOLLARS IN NET INCOME FOR A JOINT FILER. NO SINGLE TAX FILER AND NO JOINT FILER SHALL RECEIVE A REBATE GREATER THAN FIVE THOUSAND DOLLARS. § 2. This act shall take effect immediately.
