BILL NUMBER: S1943 SPONSOR: BAILEY TITLE OF BILL: An act to amend the criminal procedure law, in relation to preventing temporary questioning of person solely because such person is wearing a mask during a state emergency for an epidemic or pandemic PURPOSE: The purpose of this bill is to amend the state's current stop and frisk law to prevent law enforcement officials from unduly questioning a person solely because he or she is wearing a mask or other face covering during an epidemic or a pandemic. SUMMARY OF SPECIFIC PROVISIONS: Section one of this bill creates the prohibition. Section two sets forth the effective date.

BAILEY, FERNANDEZ, MYRIE -- read twice and ordered printed, and when printed to be committed to the Committee on Codes AN ACT to amend the criminal procedure law, in relation to preventing temporary questioning of person solely because such person is wearing a mask during a state emergency for an epidemic or pandemic THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Section 140.50 of the criminal procedure law is amended by adding a new subdivision 5 to read as follows: 5. NO PERSON SHALL BE SUBJECT TO TEMPORARY QUESTIONING SOLELY BECAUSE SUCH PERSON IS WEARING A MASK DURING A STATE EMERGENCY FOR AN EPIDEMIC OR PANDEMIC. § 2. This act shall take effect immediately.
