TITLE OF BILL:

An act to amend the public health law, in relation to allowing geriatri-
cians to apply for both the physician loan repayment program and the
physician practice support program

 
PURPOSE:

Supports the recruitment of geriatricians by making them dual-eligible
for the physician loan repayment program and the physician practice
support program

 
SUMMARY OF PROVISIONS:

Section 1: Amends section 2807-m of the public health law to provide
that a physician specializing in geriatric care will be eligible to
qualify for student loan repayment awards under both the physician loan
repayment and physician practice support programs, provided that the
physician agrees to specialize in geriatric care for at least five

years.

Section 2: Sets the effective date.

 
JUSTIFICATION:

It is estimated that the number of individuals above the age of sixty
five (65) in the United States is expected to grow 55% by 2030.  Howev-
er, to accommodate this influx of patients, the United States will
33,200 physicians to work in geriatric care, while it currently has
about 7,000 physicians doing so.

The primary problem with attracting medical professionals to work in
geriatrics is the debt burden physicians have from going to medical
school, which makes working in geriatrics a less attractive practice
choice for so many physicians, as that field typically pays less than
other areas of medical practice.

By making a physician that works in geriatrics able to qualify for
student loan repayment awards under both the physician loan repayment
and physician practice support programs, this Bill will make geriatric
care a more attractive career path for physicians. In turn, this will
help to ensure that the seniors of our State and their families will not
struggle to find a physician who practices geriatric care.

EFFECTIVE DATE:
This act shall take effect on the first of January next succeeding the
date on which it shall have become a law.

 AN ACT to amend the public health law, in relation to allowing geriatri-
   cians to apply for both the physician loan repayment program  and  the
   physician practice support program

   THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section 1.  Subdivision 12 of section 2807-m of the public health law,
 as amended by section 6 of part Y of chapter 56 of the laws of 2020,  is
 amended to read as follows:
   12. Notwithstanding any provision of law to the contrary, applications
 submitted  on or after April first, two thousand sixteen, for the physi-
 cian loan repayment program pursuant to  paragraph  (c)  of  subdivision
 five-a of this section and subdivision ten of this section or the physi-
 cian  practice  support program pursuant to paragraph (d) of subdivision
 five-a of this section, shall be subject to the following changes:
   (a) Awards shall be made from the  total  funding  available  for  new
 awards  under  the  physician  loan  repayment program and the physician
 practice support program, with neither program  limited  to  a  specific
 funding amount within such total funding available;
   (b)  An  applicant  may  apply  for an award for either physician loan
 repayment or  physician  practice  support,  but  not  both,  EXCEPT  AS
 PROVIDED UNDER PARAGRAPH (E) OF THIS SUBDIVISION;
   (c)  An applicant shall agree to practice for three years in an under-
 served area and each award shall provide up to  forty  thousand  dollars
 for each of the three years; [and]
   (d)  To the extent practicable, awards shall be timed to be of use for
 job offers made to applicants; AND
   (E) NOTWITHSTANDING PARAGRAPH (B) OF THIS  SUBDIVISION,  AN  APPLICANT
 SPECIALIZING  IN  GERIATRIC  CARE MAY BE ELIGIBLE AND APPLY FOR AN AWARD
 FOR BOTH  PHYSICIAN  LOAN  REPAYMENT  AND  PHYSICIAN  PRACTICE  SUPPORT,
 
  EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets
                       [ ] is old law to be omitted.

 PROVIDED  THAT SUCH APPLICANT AGREES TO SPECIALIZE IN GERIATRIC CARE FOR
 AT LEAST FIVE YEARS.
   §  2. This act shall take effect on the first of January next succeed-
 ing the date on which it shall have become a law. Effective immediately,
 the addition, amendment and/or repeal of any rule or  regulation  neces-
 sary  for  the  implementation  of  this  act  on its effective date are
 authorized to be made and completed on or before such effective date.
