 AN ACT to amend the real property tax law, in relation to establishing a
   real property tax exemption  for  veterans  who  have  a  one  hundred
   percent service connected disability
 
   THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section 1. Section 458 of the real property  tax  law  is  amended  by
 adding a new subdivision 3-a to read as follows:
   3-A.  REAL  PROPERTY OWNED BY A DISABLED VETERAN WHO HAS A ONE HUNDRED
 PERCENT SERVICE CONNECTED DISABILITY, AND HIS OR HER SPOUSE, AND CONSTI-
 TUTING THE PRIMARY RESIDENCE OF  SUCH  PERSONS  SHALL  BE  DEEMED  FULLY
 EXEMPT  FROM  ALL TAXES IMPOSED UPON SUCH PROPERTY BY A MUNICIPAL CORPO-
 RATION.
   § 2. This act shall take effect immediately.

 AN ACT to amend the real property tax law, in relation to establishing a
   real  property  tax  exemption  for  veterans  who  have a one hundred
   percent service connected disability
 
   THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section  1.  Section  458-a of the real property tax law is amended by
 adding a new subdivision 11 to read as follows:
   11. A COUNTY, CITY, TOWN, VILLAGE OR SCHOOL DISTRICT MAY ADOPT A LOCAL
 LAW OR RESOLUTION TO INCLUDE THE  PRIMARY  RESIDENCE  OF  ANY  SERIOUSLY
 DISABLED VETERAN WHO:
   (A)(I)  WAS  DISCHARGED  OR  RELEASED THEREFROM UNDER HONORABLE CONDI-
 TIONS;
   (II) HAS A QUALIFYING CONDITION, AS DEFINED  IN  SECTION  ONE  OF  THE
 VETERANS'  SERVICES  LAW,  AND  HAS  RECEIVED A DISCHARGE OTHER THAN BAD
 CONDUCT OR DISHONORABLE FROM SUCH SERVICE; OR
   (III) IS A DISCHARGED LGBT VETERAN, AS DEFINED IN SECTION ONE  OF  THE
 VETERANS'  SERVICES  LAW,  AND  HAS  RECEIVED A DISCHARGE OTHER THAN BAD
 CONDUCT OR DISHONORABLE FROM SUCH SERVICE; AND
   (B) (I) IS CONSIDERED TO BE PERMANENTLY  AND  TOTALLY  DISABLED  AS  A
 RESULT OF MILITARY SERVICE;
   (II)  IS  RATED  ONE  HUNDRED  PERCENT  DISABLED  BY THE UNITED STATES
 DEPARTMENT OF VETERANS AFFAIRS;

Remember this when you vote that they don’t take care of veterans. Time to get someone in office that does.

New Jersey and Pennsylvania and several other state already have similar legislation. Get on board NY or we will move.

This passed the Senate side unanimously. I reached out to the Assembly and they didnt like the language so they amended it (A2965A). That passed the assembly committee unanimously by died in the assembly because the senate didnt do an amendment. If the senate this time uses the same language as the assembly, it will get to the governers desk. Call your assembly and senate and committee chairs.

18 other states offer this benefit. Why can’t NY be more Veteran friendly? This is why people are leaving the state. Can’t get this passed.

If the Assembly version, where municipalities can opt out, will be the death of this in practical terms. In conference committee they really need to REQUIRE municipalities to accept the tax exemption. All the other parts of the Assembly version is pretty harmless. Please Senator, give the assembly the parts they want to keep this as a mandate. Otherwise there is no real point.
