TITLE OF BILL:

An act to amend the administrative code of the city of New York, in
relation to prohibiting wind turbines from being located within 1500
feet of residential areas and/or commercial shopping districts

 
PURPOSE:

The Purpose of the bill is to prohibit the construction and placement of
wind turbines near populated areas.

 
SUMMARY OF SPECIFIC PROVISIONS:

The new section 27-521.17 ("Wind turbines") prohibits the construction
and placement of wind turbines in populated and heavily trafficked areas
in New York City - namely, residential areas and commercial shopping
districts.

The second section sets forth the effective date.

 
JUSTIFICATION:

In late December 2019, during the busy holiday season, a giant wind
turbine previously constructed at 500 Baychester Avenue in the Bronx
came crashing down, leaving a path of destruction in its wake. The area
is densely populated. It was a miracle that no one was hurt.

Climate change is undeniable, and we must do everything in our power to
protect our planet. We ought to move ever closer to using renewable
sources of clean, sustainable energy, but not at the expense of public
safety.

Placing a giant wind turbine near the intersection of Baychester and
Bartow Avenues in the Bronx - in an active and densely populated
thoroughfare of Co-op City - was inconsistent with public safety.The
owner of the property utterly failed to obtain feedback from the commu-
nity, and his failure to do so could have resulted in death.

This new legislation is intended to never let that happen again.

 AN  ACT  to  amend  the  administrative code of the city of New York, in
   relation to prohibiting wind turbines from being located  within  1500
   feet of residential areas and/or commercial shopping districts
 
   THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section 1. Subchapter 7 of chapter 1 of title 27 of the administrative
 code of the city of New York is amended by adding a new  article  23  to
 read as follows:
                                 ARTICLE 23
                               WIND TURBINES
 
   SECTION 27-521.17 WIND TURBINES.
   § 27-521.17   WIND  TURBINES.  NO  WIND  TURBINES  SHALL  BE  LOCATED,
 CONSTRUCTED, OR OPERATED WITHIN ONE THOUSAND  FIVE  HUNDRED  FEET  OF  A
 RESIDENTIAL AREA AND/OR A COMMERCIAL SHOPPING DISTRICT.
   § 2. This act shall take effect immediately.
