BILL NUMBER: S2239 SPONSOR: WEIK TITLE OF BILL: An act to amend the public health law, in relation to requiring nursing homes and assisted living facilities to provide and maintain automated external defibrillators PURPOSE: To ensure nursing homes and assisted living facilities have AEDs on site at all times. SUMMARY OF PROVISIONS: Section 1 amends section 225 of the public health law by creating a new subdivision 5-d that would require nursing homes and assisted living facilities provide and maintain on-site an AED. Section 2 sets forth an effective date 90 days after the bill shall become law.

WEIK -- read twice and ordered printed, and when printed to be committed to the Committee on Health AN ACT to amend the public health law, in relation to requiring nursing homes and assisted living facilities to provide and maintain automated external defibrillators THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Section 225 of the public health law is amended by adding a new subdivision 5-d to read as follows: 5-D. NOTWITHSTANDING THE PROVISIONS OF PARAGRAPH (R) OF SUBDIVISION FIVE OF THIS SECTION, THE SANITARY CODE SHALL PROVIDE THAT EACH NURSING HOME AND ASSISTED LIVING FACILITY LICENSED BY THE DEPARTMENT SHALL PROVIDE AND MAINTAIN ON-SITE AUTOMATED EXTERNAL DEFIBRILLATOR (AED) EQUIPMENT, AS DEFINED IN PARAGRAPH (A) OF SUBDIVISION ONE OF SECTION THREE THOUSAND-B OF THIS CHAPTER, IN QUANTITIES AND TYPES DEEMED BY THE COMMISSIONER TO BE ADEQUATE TO ENSURE READY AND APPROPRIATE ACCESS FOR USE DURING EMERGENCIES. SUCH NURSING HOME AND ASSISTED LIVING FACILITIES AND STAFF SHALL BE SUBJECT TO THE REQUIREMENTS AND LIMITATIONS OF SECTION THREE THOUSAND-B OF THIS CHAPTER. § 2.
