BILL NUMBER: S2626 SPONSOR: MAY TITLE OF BILL: An act to amend the public health law and the social services law, in relation to allowing personal caregivers to visit residents of adult care facilities PURPOSE OR GENERAL IDEA OF BILL: To allow personal caregiving visitors in adult care facilities at all times. SUMMARY OF PROVISIONS: Section 1: amends subdivision 2 of section law, as amended by chapter 108 of the laws limiting personal caregiving to times when declared. Section 2: amends subdivision 2 of section law, as amended by chapter 107 of the laws limiting personal caregiving to times when declared. 2801-h of the public health of 2021, to remove language public health

MAY -- read twice and ordered printed, and when printed to be committed to the Committee on Health AN ACT to amend the public health law and the social services law, in relation to allowing personal caregivers to visit residents of adult care facilities THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Subdivision 2 of section 2801-h of the public health law, as amended by chapter 108 of the laws of 2021, is amended to read as follows: 2. [During a public health emergency declared under section twenty- four or section twenty-eight of the executive law personal] PERSONAL caregiving visitors may visit residents of nursing homes, in compliance with federal law and regulations and state regulations made under this section. Nursing homes shall admit any personal caregiving visitor who is in compliance with applicable requirements under this section. § 2. Subdivision 2 of section 461-u of the social services law, as amended by chapter 108 of the laws of 2021, is amended to read as follows: 2. [During a public health emergency declared under section twenty- four or section twenty-eight of the executive law personal] PERSONAL caregiving visitors may visit residents of adult care facilities, in compliance with federal law and regulations and state regulations made under this section. Adult care facilities shall admit any personal care- giving visitor who is in compliance with applicable requirements under this section. § 3. This act shall take effect immediately.
