BILL NUMBER: S2778 SPONSOR: ADDABBO TITLE OF BILL: An act to amend the criminal procedure law, in relation to designating sheriffs, under-sheriffs and deputy sheriffs of the city of New York as police officers PURPOSE: Relates to the definition of a police officer. SUMMARY OF PROVISIONS: Section 1 amend- paragraph (o) of subdivision 34 of section 1.20 of the Criminal Procedure Law. This law amends Criminal Procedure Law 120, section 34, subdivision (b) of the consolidated laws of the State of New York to provide that the Sheriff, Under-sheriffs, and Deputy Sheriffs of the City of New York be considered police officers. ADDABBO -- read twice and ordered printed, and when printed to be committed to the Committee on Codes AN ACT to amend the criminal procedure law, in relation to designating sheriffs, under-sheriffs and deputy sheriffs of the city of New York as police officers THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Paragraph (b) of subdivision 34 of section 1.20 of the criminal procedure law is amended to read as follows: (b) Sheriffs, under-sheriffs and deputy sheriffs [of counties outside of New York City]; § 2. Paragraph (b) of subdivision 34 of section 1.20 of the criminal procedure law, as amended by section 13 of part BBB of chapter 59 of the laws of 2021, is amended to read as follows: (b) Sheriffs, under-sheriffs and deputy sheriffs [of counties outside of New York City where such department is certified in accordance with paragraph (d) of subdivision one of section eight hundred forty-six-h of the executive law]; § 3. Subdivision 2 of section 2.10 of the criminal procedure law, as amended by chapter 969 of the laws of 1983, is amended to read as follows: 2. [The sheriff, undersheriff and deputy sheriffs of New York city and sworn] SWORN officers of the Westchester county department of public safety services appointed after January thirty-first, nineteen hundred eighty-three to the title of public safety officer and who perform the functions previously performed by a Westchester county deputy sheriff on or prior to such date. § 4. This act shall take effect immediately; provided, however, that section two of this act shall take effect on the same date and in the same manner as section 13 of part BBB of chapter 59 of the laws of 2021, takes effect.
