BILL NUMBER: S2819 SPONSOR: SKOUFIS TITLE OF BILL: An act to amend the town law, in relation to specifying watershed protection improvement districts may work towards the preservation of development rights PURPOSE: To authorize municipalities to take certain actions for the protection and restoration of groundwater, surface waters, and drinking water qual- ity, including the preservation of development rights. SUMMARY OF PROVISIONS: Section 1: Amends section 198 of the town law to permit towns to take certain actions for the protection and restoration of groundwater, surface waters, and drinking water quality to include the preservation of development rights.

SKOUFIS -- read twice and ordered printed, and when printed to be committed to the Committee on Local Government AN ACT to amend the town law, in relation to specifying watershed protection improvement districts may work towards the preservation of development rights THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Subdivision 10-g of section 198 of the town law, as added by chapter 378 of the laws of 2012, is amended to read as follows: 10-g. Watershed protection improvement district. After a watershed protection improvement district has been established, the town board may take such action as may be required to adopt plans and specifications and enter into a contract or contracts, or take such other actions as may be required, for the protection and restoration of groundwater, surface waters, and drinking water quality as it may deem to be neces- sary or desirable, including but not limited to stormwater treatment projects [and], wetland construction, AND PRESERVATION OF DEVELOPMENT RIGHTS. § 2.
