 AN ACT to amend the public health law and  the  state  finance  law,  in
   relation to establishing a reproductive health services training grant
   program

   THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section 1. The public health law is amended by adding  a  new  section
 2807-nn to read as follows:
   §  2807-NN.  REPRODUCTIVE HEALTH TRAINING AND EDUCATION GRANT PROGRAM.
 1. AS USED IN THIS SECTION, "ELIGIBLE PARTICIPANT" MEANS  AN  INTERN  OR
 RESIDENT  WHO  IS  EMPLOYED  BY  A  HOSPITAL OR OTHERWISE ENROLLED IN AN
 ACCREDITED GRADUATE MEDICAL EDUCATION PROGRAM.
   2. THE COMMISSIONER, SHALL ESTABLISH A  REPRODUCTIVE  HEALTH  SERVICES
 TRAINING  AND  EDUCATION  GRANT  PROGRAM  FOR  ELIGIBLE  PARTICIPANTS AS
 DEFINED IN SUBDIVISION ONE OF THIS SECTION.  SUCH  GRANT  PROGRAM  SHALL
 CONSIST  OF  TWO  TO  SIX  WEEKS OF CLINICAL TRAINING IN ACCORDANCE WITH
 ACCREDITATION COUNCIL FOR GRADUATE MEDICAL EDUCATION STANDARDS FOR CLIN-
 ICAL TRAINING IN THE PERFORMANCE OF ABORTION  AND  RELATED  REPRODUCTIVE
 HEALTH  SERVICES  AND  SHALL  OTHERWISE  MEET  PROFESSIONALLY RECOGNIZED
 TRAINING STANDARDS AS DEFINED BY THE COMMISSIONER.
   3. THE COMMISSIONER IS AUTHORIZED,  WITHIN  AMOUNTS  APPROPRIATED  FOR
 SUCH  PURPOSE  TO  MAKE GRANTS IN ACCORDANCE WITH THIS SUBDIVISION. SUCH
 GRANTS MAY BE USED FOR ADMINISTRATION, FACULTY RECRUITMENT AND  DEVELOP-
 MENT,  START-UP  COSTS  AND  COSTS INCURRED TEACHING REPRODUCTIVE HEALTH
 CARE  IN  HOSPITAL-BASED  PROGRAMS  OR  NON-HOSPITAL-BASED  CARE  SITES,
 INCLUDING,  BUT  NOT  LIMITED  TO, PERSONNEL, ADMINISTRATION AND TRAINEE
 RELATED EXPENSES AND OTHER EXPENSES JUDGED REASONABLE AND  NECESSARY  BY
 THE  COMMISSIONER.  AS  USED IN THIS SECTION, "TRAINEE RELATED EXPENSES"
 SHALL INCLUDE A TRAVEL AND HOUSING STIPEND PAID TO EACH INTERN OR  RESI-
 DENT IF DEEMED NECESSARY.

   § 2. The state finance law is amended by adding a new section 99-qq to
 read as follows:
   §  99-QQ. REPRODUCTIVE HEALTH TRAINING AND EDUCATION FUND. 1. THERE IS
 HEREBY ESTABLISHED IN THE JOINT CUSTODY OF  THE  STATE  COMPTROLLER  AND
 COMMISSIONER  OF  TAXATION AND FINANCE A SPECIAL FUND TO BE KNOWN AS THE
 "REPRODUCTIVE HEALTH TRAINING AND EDUCATION FUND".
   2. SUCH FUND SHALL CONSIST OF ALL MONEYS APPROPRIATED THERETO FROM ANY
 OTHER FUND OR SOURCE PURSUANT TO LAW. NOTHING CONTAINED IN THIS  SECTION
 SHALL PREVENT THE STATE FROM RECEIVING GRANTS, GIFTS OR BEQUESTS FOR THE
 PURPOSES OF THE FUND AS DEFINED IN THIS SECTION AND DEPOSITING THEM INTO
 THE FUND ACCORDING TO LAW.
   3.  MONEYS  SHALL BE PAYABLE FROM THE FUND ON THE AUDIT AND WARRANT OF
 THE COMPTROLLER ON VOUCHERS APPROVED AND CERTIFIED BY  THE  COMMISSIONER
 OF HEALTH.
   4.  THE  MONEYS  IN  SUCH  FUND SHALL BE EXPENDED FOR THE REPRODUCTIVE
 HEALTH SERVICES TRAINING AND EDUCATION GRANT PROGRAM IN ACCORDANCE  WITH
 THE  PROVISIONS  OF  SECTION TWENTY-EIGHT HUNDRED SEVEN-NN OF THE PUBLIC
 HEALTH LAW.
   § 3. This act shall take effect on the thirtieth day  after  it  shall
 have become a law. Effective immediately, the addition, amendment and/or
 repeal  of  any  rule  or regulation necessary for the implementation of
 this act on its effective date are authorized to be made  and  completed
 on or before such effective date.

TITLE OF BILL:

An act to amend the public health law and the state finance law, in
relation to establishing a reproductive health services training and
education grant program

 
SUMMARY OF PROVISIONS:

Section 1 amends the public health law by adding a new section 2807-nn
to establish a reproductive training and education grant program admin-
istered by the commissioner

Section 2 amends the state finance law by adding a new section 99-qq to
establish the reproductive health training and education fund

Section 3 provides the effective date

 
JUSTIFICATION:

Since the Dobbs ruling, 70 percent of medical students find themselves
training in abortion restrictive states according to analysis published
by The Lancet. Concurrently, there is a shortage of licensed physicians
in New York City and state able to address complex cases, and a lack of
training for advanced practice clinicians. This legislation creates a
fund to support the training of medical residents and other practition-
ers in New York, an abortion protective state with leading reproductive
health and family planning residency programs. Grants would support the
travel and lodging costs of residents, the expansion of residency
programs to accommodate additional residents, and certain costs of
community-based training sites.

The Dobbs decision greatly jeopardized access to and the provision of
reproductive healthcare. This legislation reduces barriers for medical
Residents and practitioners who want to train and provide essential
medical care that has been wrongly politicized.

 WHO  IS  EMPLOYED  BY  A HOSPITAL OR OTHERWISE ENROLLED IN AN ACCREDITED
 GRADUATE MEDICAL EDUCATION PROGRAM;
   (B) "PROGRAM" SHALL MEAN A REPRODUCTIVE HEALTH SERVICES  TRAINING  AND
 EDUCATION GRANT PROGRAM; AND
   (C)  "ELIGIBLE  PROVIDERS"  SHALL  MEAN  COMMUNITY-BASED ORGANIZATIONS
 PROVIDING REPRODUCTIVE HEALTH CARE, CONTINUING  EDUCATION  PROGRAMS  FOR
 QUALIFIED PROVIDERS THROUGH PROFESSIONAL ASSOCIATIONS OR CLINICAL EDUCA-
 TION PROGRAMS.
   2.  THE  COMMISSIONER  SHALL  ESTABLISH A REPRODUCTIVE HEALTH SERVICES
 TRAINING AND EDUCATION GRANT PROGRAM FOR  ELIGIBLE  PROVIDERS  TO  TRAIN
 ELIGIBLE  PARTICIPANTS IN THE PERFORMANCE OF ABORTION AND RELATED REPRO-
 DUCTIVE HEALTH SERVICES. SUCH  ELIGIBLE  PROVIDERS  SHALL  MEET  PROFES-
 SIONALLY RECOGNIZED TRAINING STANDARDS, COMPLY WITH APPLICABLE STATE LAW

 AND  REGULATIONS, AND SHALL BE CAPABLE OF PROVIDING CULTURALLY CONGRUENT
 CARE AND IMPLICIT BIAS TRAINING.
   3.  THE  COMMISSIONER  IS  AUTHORIZED, WITHIN AMOUNTS APPROPRIATED FOR
 SUCH PURPOSE TO MAKE GRANTS IN ACCORDANCE WITH  THIS  SUBDIVISION.  SUCH
 GRANTS  MAY BE USED FOR ADMINISTRATION, FACULTY RECRUITMENT AND DEVELOP-
 MENT, START-UP COSTS AND COSTS  INCURRED  TEACHING  REPRODUCTIVE  HEALTH
 CARE.
   4.  THE  COMMISSIONER SHALL SUBMIT A REPORT, ON DECEMBER THIRTY-FIRST,
 TWO THOUSAND TWENTY-THREE AND ANNUALLY THEREAFTER, TO THE  GOVERNOR  AND
 TO THE LEGISLATURE WHICH SHALL INCLUDE, BUT NOT BE LIMITED TO, THE TOTAL
 AMOUNT OF GRANTS ISSUED, THE NUMBER OF ELIGIBLE PARTICIPANTS, THE NUMBER
 OF  ELIGIBLE  PROVIDERS,  AND THE REGION OF THE STATE WHERE THE ELIGIBLE
 PROVIDER IS LOCATED. NOTWITHSTANDING ANY OTHER  PROVISION  OF  LAW,  THE
 COMMISSIONER  SHALL  NOT  REPORT  ANY INFORMATION RELATED TO IDENTIFYING
 INFORMATION OF ELIGIBLE PARTICIPANTS IN THE PROGRAM.
   § 2. The state finance law is amended by adding a new section 99-g  to
 read as follows:
   §  99-G.  REPRODUCTIVE HEALTH SERVICES TRAINING AND EDUCATION FUND. 1.
 THERE IS HEREBY ESTABLISHED IN THE JOINT  CUSTODY  OF  THE  STATE  COMP-

 HUNDRED  NINETY-NINE-BB  OF THIS ARTICLE OR AN INTERN OR RESIDENT WHO IS
 EMPLOYED BY A HOSPITAL OR OTHERWISE ENROLLED IN AN  ACCREDITED  GRADUATE
 MEDICAL EDUCATION PROGRAM;
   (B)  "PROGRAM"  SHALL MEAN A REPRODUCTIVE HEALTH SERVICES TRAINING AND
 EDUCATION GRANT PROGRAM;
   (C) "PROFESSIONAL EDUCATOR" SHALL MEAN  COMMUNITY-BASED  ORGANIZATIONS
 PROVIDING  REPRODUCTIVE  HEALTH  CARE, CONTINUING EDUCATION PROGRAMS FOR
 QUALIFIED PROVIDERS THROUGH PROFESSIONAL ASSOCIATIONS OR CLINICAL EDUCA-
 TION PROGRAMS THAT MEET PROFESSIONALLY  RECOGNIZED  TRAINING  STANDARDS,
 COMPLY  WITH  APPLICABLE  STATE LAWS AND REGULATIONS, AND ARE CAPABLE OF
 PROVIDING CULTURALLY CONGRUENT CARE AND IMPLICIT BIAS TRAINING; AND
   (D) "ABORTION" SHALL HAVE THE SAME MEANING AS IS SET FORTH IN  SECTION
 TWENTY-FIVE HUNDRED NINETY-NINE-BB OF THIS ARTICLE.

   2.  THERE  IS  HEREBY ESTABLISHED WITHIN THE DEPARTMENT A REPRODUCTIVE
 HEALTH SERVICES TRAINING AND EDUCATION GRANT PROGRAM  TO  ENSURE  HEALTH
 CARE  PROVIDERS  RECEIVE ADEQUATE TRAINING IN ABORTION CARE. THE PROGRAM
 SHALL PROVIDE FUNDING FOR PROFESSIONAL EDUCATORS THAT PROVIDE OR FACILI-
 TATE  CLINICAL  EDUCATION  RELATED  TO  ABORTION  CARE AND OTHER RELATED
 REPRODUCTIVE HEALTH SERVICES. THE PROGRAM SHALL BE DESIGNED  TO  PROVIDE
 SUPPORT TO CLINICAL EDUCATORS IN PROGRAM DEVELOPMENT AND ADMINISTRATION,
 AND  TO  ADDRESS  THE  SUPPORT  NEEDS  OF INDIVIDUALS SEEKING ADDITIONAL
 TRAINING ON ABORTION CARE. FUNDING USED TO SUPPORT THE PROGRAM SHALL  BE
 SUBJECT TO APPROPRIATION.
   3.  THE  COMMISSIONER  SHALL  DISTRIBUTE FUNDS MADE AVAILABLE FOR THIS
 PURPOSE UNDER THIS SECTION. IN DETERMINING FUNDING FOR APPLICANTS  UNDER
 THE  GRANT PROGRAM, THE COMMISSIONER SHALL CONSIDER THE FOLLOWING CRITE-
 RIA AND GOALS:
   (A) PROGRAM DEVELOPMENT AND ADMINISTRATION. FUNDS MAY  BE  AWARDED  TO
 SUPPORT THE ADMINISTRATION AND OPERATION OF CLINICAL EDUCATION PROGRAMS,
 FACULTY  RECRUITMENT  AND  DEVELOPMENT,  AND  THE EXPANSION OF RESIDENCY
 PROGRAMS TO ACCOMMODATE ADDITIONAL PLACEMENTS.
   (B) ADDRESSING  PRACTICAL  SUPPORT  NEEDS  OF  ELIGIBLE  PARTICIPANTS.
 FUNDS  MAY  BE  AWARDED  TO SUPPORT AN ELIGIBLE PARTICIPANT IN OBTAINING
 CLINICAL EDUCATION  ON  ABORTION  CARE  AND  OTHER  REPRODUCTIVE  HEALTH
 SERVICES,  INCLUDING,  BUT  NOT LIMITED TO, FINANCIAL SUPPORT FOR TRAVEL
 AND LODGING ASSOCIATED WITH ATTENDING A PROGRAM.
   4. IN ESTABLISHING AND OPERATING THE  PROGRAM,  THE  COMMISSIONER  MAY
 CONSULT  A  RANGE OF EXPERTS, INCLUDING, BUT NOT LIMITED TO, INDIVIDUALS
 AND ENTITIES PROVIDING ABORTION CARE, ABORTION FUNDS, AND  OTHER  ORGAN-
 IZATIONS  WHOSE  MISSION IS TO EXPAND ACCESS TO ABORTION CARE, TO ENSURE
 THE PROGRAM STRUCTURE AND EXPENDITURES REFLECT  THE  NEEDS  OF  ABORTION
 PROVIDERS, ABORTION FUNDS AND CONSUMERS. THE COMMISSIONER MAY MAKE REGU-
 LATIONS NECESSARY FOR IMPLEMENTATION OF THE PROGRAM.
   5.  THE COMMISSIONER SHALL SUBMIT A REPORT NO LATER THAN TWELVE MONTHS
 AFTER THE EFFECTIVE DATE OF THIS SECTION AND ANNUALLY THEREAFTER, TO THE
 GOVERNOR AND TO THE LEGISLATURE, WHICH SHALL INCLUDE, BUT NOT BE LIMITED
 TO, THE TOTAL AMOUNT OF GRANTS ISSUED, THE NUMBER  OF  ELIGIBLE  PARTIC-
 IPANTS,  THE  NUMBER  OF ELIGIBLE PROVIDERS, AND THE REGION OF THE STATE
 WHERE THE ELIGIBLE PROVIDERS  ARE  LOCATED.  NOTWITHSTANDING  ANY  OTHER
 PROVISION  OF  LAW,  THE  COMMISSIONER  SHALL NOT REPORT ANY INFORMATION
 RELATED TO IDENTIFYING  INFORMATION  OF  ELIGIBLE  PARTICIPANTS  IN  THE
 PROGRAM.
   §  2. This act shall take effect on the first of April next succeeding
 the date upon which it shall have become a law.  Effective  immediately,
 the  addition,  amendment and/or repeal of any rule or regulation neces-
 sary for the implementation of  this  act  on  its  effective  date  are
 authorized to be made and completed on or before such effective date.
