BILL NUMBER: S3195 SPONSOR: MANNION TITLE OF BILL: An act to amend the penal law, in relation to allowing persons partic- ipating in certain formal ceremonies to possess a firearm, rifle or shotgun PURPOSE OR GENERAL IDEA OF BILL: The purpose of this bill is to allow individuals to carry firearms, rifles or shotguns in sensitive places for ceremonial purposes and twen- ty-one gun salutes SUMMARY OF PROVISIONS: Section 1 of this bill would create an exemption for military ceremonies with approval by the municipality or by the military, law enforcement or fire prevention organization. MANNION, HINCHEY -- read twice and ordered printed, and when printed to be committed to the Committee on Codes AN ACT to amend the penal law, in relation to allowing persons partic- ipating in certain formal ceremonies to possess a firearm, rifle or shotgun THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Paragraphs (i) and (j) of subdivision 3 of section 265.01-e of the penal law, as added by chapter 371 of the laws of 2022, are amended and a new paragraph (k) is added to read as follows: (i) persons lawfully engaged in hunting activity, including hunter education training; [or] (j) persons operating a program in a sensitive location out of their residence, as defined by this section, which is licensed, certified, authorized, or funded by the state or a municipality, so long as such possession is in compliance with any rules or regulations applicable to the operation of such program and use or storage of firearms; OR (K) PERSONS NOT OTHERWISE LISTED UNDER THIS SUBDIVISION WHO ARE PARTICIPATING IN A MILITARY CEREMONY, A FORMAL CEREMONY INCLUDING A TWENTY-ONE GUN SALUTE, AND/OR ANY OTHER FORMAL CEREMONY HONORING A PERSON OR PERSONS WHO SERVED THEIR MUNICIPALITY, STATE, AND/OR COUNTRY IN AN OFFICIAL CAPACITY, PROVIDED, HOWEVER, THAT SUCH PERSONS OBTAIN PRIOR APPROVAL FROM EITHER: (I) THE MUNICIPALITY IN WHICH SUCH CEREMONY WILL OCCUR; OR (II) THE MILITARY, LAW ENFORCEMENT, OR FIRE PREVENTION ORGANIZATION HOSTING SUCH CEREMONY. § 2.
