BILL NUMBER: S3208 SPONSOR: CLEARE TITLE OF BILL: An act to amend the environmental conservation law, in relation to prohibiting marine solid waste transfer stations located in proximity to public housing projects in certain cases PURPOSE OR GENERAL IDEA OF BILL: To prohibit the construction, location, relocation, and reactivation of marine putrescible or non-putrescible solid waste transfer stations or facilities within 800 feet of public housing projects in cities of one million or more. SUMMARY OF PROVISIONS: Prohibits the DEC or local agencies from issuing permits which would allow the siting of a marine transfer station within 800 feet of public housing.

CLEARE -- read twice and ordered printed, and when printed to be committed to the Committee on Environmental Conservation AN ACT to amend the environmental conservation law, in relation to prohibiting marine solid waste transfer stations located in proximity to public housing projects in certain cases THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. The environmental conservation law is amended by adding a new section 27-0721 to read as follows: § 27-0721. MARINE SOLID WASTE TRANSFER STATION OR FACILITIES. NOTWITHSTANDING ANY INCONSISTENT PROVISION OF STATE OR LOCAL LAW OR REGULATION, NEITHER THE DEPARTMENT NOR ANY LOCAL AGENCY, DEPARTMENT OR AUTHORITY SHALL ISSUE A PERMIT, REGULATION, OR RENEW A PERMIT OR APPROVE AN APPLICATION FOR THE EXPANSION, CONSTRUCTION, RELOCATION, REACTIVATION OR OPERATION OF A MARINE SOLID WASTE TRANSFER STATION OR FACILITY IN A CITY WITH A POPULATION OF ONE MILLION OR MORE, WHERE ANY PART OF SUCH STATION OR FACILITY IS TO BE LOCATED WITHIN EIGHT HUNDRED FEET OF A HOUSING PROJECT AS THE TERM PROJECT IS DEFINED IN SUBDIVISION FOURTEEN OF SECTION THREE OF THE PUBLIC HOUSING LAW. § 2.
