TITLE OF BILL:

An act to amend the social services law, in relation to providing resi-
dential and day services to certain individuals with a developmental
disability

 
PURPOSE:

To create parity for Integrated Residential Communities as it relates to
billing for services provided to people with developmental disabilities.

 
SUMMARY OF PROVISIONS:

Section 1: Amends subdivision 3 of section 365-a of the social services
law by adding a new paragraph that clarifies that services, including
residential and day services, for eligible individuals with a develop-
mental disability provided by an integrated residential community
program certified by the Office of People with Developmental Disabili-
ties as a residential program and recognized by OPWDD as a service

delivery alternative shall be encompassed within the term "medical
assistance."

Section 2: Amends subdivision 6 of section 3614 of the public health law
to require the commissioner to establish rates of payment for services
provided by a long term care community established pursuant to the
provisions of chapter 594 of the laws of 2011.

Section 3: Effective date

 
JUSTIFICATION:

Currently, there are two Integrated Residential Communities in New York.
This designation was created specifically to classify Camphill Communi-
ties, which are communities of developmentally disabled people and able-
minded people living and working together in a rural agricultural
setting. Currently, there is a funding discrepancy that prohibits resi-
dents of these organizations from receiving day habilitation services
through medicaid. This legislation clarifies that residents are eligible
for both day and residential habilitation services.

This change will ensure that residents of Camphill Village and Camphill
Trifomi can continue to live in their homes on solid financial ground.
The residents and their families receive excellent services at Camphill,
and it is important that they are not separated from their homes and
services because of the classification of the facility.

FISCAL IMPLICATIONS:

Modest additional cost to Medicaid for reimbursing services at the two
Integrated Residential Communities in New York State.

 
EFFECTIVE DATE:
This act shall take effect on the first of April next succeeding the
date it shall have become law.

 AN ACT to amend the social services law, in relation to providing  resi-
   dential  and  day services to certain individuals with a developmental
   disability

   THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section  1.  Subdivision 3 of section 365-a of the social services law
 is amended by adding a new paragraph (e) to read as follows:
   (E) SERVICES, INCLUDING RESIDENTIAL AND  DAY  SERVICES,  FOR  ELIGIBLE
 INDIVIDUALS  WITH  A  DEVELOPMENTAL DISABILITY PROVIDED BY AN INTEGRATED
 RESIDENTIAL COMMUNITY PROGRAM CERTIFIED BY THE  OFFICE  OF  PEOPLE  WITH
 DEVELOPMENTAL  DISABILITIES  AS  A RESIDENTIAL PROGRAM AND RECOGNIZED BY
 THE SAME OFFICE AS A SERVICE DELIVERY ALTERNATIVE.
   § 2. This act shall take effect on the first of January next  succeed-
