BILL NUMBER: S3491 SPONSOR: WEIK TITLE OF BILL: An act to amend the public authorities law, in relation to establishing a home heating oil rebate program; and providing for the repeal of such provisions upon expiration thereof PURPOSE: To provide some relief to home heating oil consumers who are struggling with the highest rates of inflation in 40 years. SUMMARY OF PROVISIONS: Section 1 creates a new section 1885 of the public authorities law to authorize the New York State Energy Research and Development Authority (NYSERDA) to establish and administer a home heating oil rebate program. The rebate will equal $1.00 per gallon, up to a maximum of 500 gallons, of number 2 heating oil purchased from July 1, 2022 to June 30, 2023.

WEIK -- read twice and ordered printed, and when printed to be committed to the Committee on Energy and Telecommuni- cations AN ACT to amend the public authorities law, in relation to establishing a home heating oil rebate program; and providing for the repeal of such provisions upon expiration thereof THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. The public authorities law is amended by adding a new section 1885 to read as follows: § 1885. HOME HEATING OIL REBATE PROGRAM. 1. THE AUTHORITY IS HEREBY AUTHORIZED TO ESTABLISH AND ADMINISTER A HOME HEATING OIL REBATE PROGRAM. THE AUTHORITY SHALL BE RESPONSIBLE FOR GATHERING ALL NECESSARY RESIDENTIAL CUSTOMER PURCHASE DATA FROM ALL REGISTERED HOME HEATING OIL DEALERS IN THE STATE. 2. THE AUTHORITY SHALL HAVE THE RESPONSIBILITY OF DISTRIBUTING REBATE CHECKS TO RESIDENTIAL HOME HEATING OIL CUSTOMERS. SUCH REBATE SHALL BE IN THE AMOUNT OF ONE DOLLAR PER GALLON, UP TO A LIMIT OF FIVE HUNDRED GALLONS, OF NUMBER TWO HEATING OIL PURCHASED BETWEEN THE DATES OF JULY FIRST, TWO THOUSAND TWENTY-THREE AND JUNE THIRTIETH, TWO THOUSAND TWEN- TY-FOUR. 3. THE AUTHORITY SHALL PROMULGATE RULES AND REGULATIONS FOR THE ADMIN- ISTRATION OF A HOME HEATING OIL REBATE PROGRAM ESTABLISHED PURSUANT TO THIS SECTION, INCLUDING BUT NOT LIMITED TO ELIGIBILITY CRITERIA, APPLI- CATION PROCEDURES, AND DOCUMENTATION AND COMPLIANCE REQUIREMENTS FOR THE PROGRAM. § 2. This act shall take effect immediately and shall expire December 31, 2024 when upon such date the provisions of this act shall be deemed repealed.
