Relates to the misbranding of food products not containing meat; establishes a food product shall be deemed to be misbranded if the food product is labeled or branded in a false, deceptive or misleading manner that misrepresents the product as meat, meat food product or poultry.

 Introduced  by Sen. SCARCELLA-SPANTON -- read twice and ordered printed,
   and when printed to be committed to the Committee on Agriculture
 
 AN ACT to amend the agriculture and markets  law,  in  relation  to  the
   misbranding of food products not containing meat
 
   THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section 1. The agriculture and markets law is amended by adding a  new
 section 201-j to read as follows:
   §  201-J.  MISBRANDING  OF  FOOD  PRODUCTS NOT CONTAINING MEAT. A FOOD
 PRODUCT SHALL BE DEEMED TO BE MISBRANDED IF THE FOOD PRODUCT IS  LABELED
 OR BRANDED IN A FALSE, DECEPTIVE OR MISLEADING MANNER THAT MISREPRESENTS
 THE  PRODUCT  AS MEAT OR MEAT FOOD PRODUCT AS THOSE TERMS ARE DEFINED IN
 SECTION NINETY-SIX-G OF THIS CHAPTER OR AS POULTRY AS DEFINED IN SECTION
 NINETY-B OF THIS CHAPTER.
   § 2. This act shall take effect on the one hundred twentieth day after
 it shall have become a law.  Effective immediately, the addition, amend-
 ment and/or repeal of any rule or regulation necessary for the implemen-
 tation of this act on its effective date are authorized to be made on or
 before such date.
