BILL NUMBER: S4124 SPONSOR: LANZA TITLE OF BILL: An act to amend the retirement and social security law, in relation to increasing the retiree public earnings cap PURPOSE: This bill would increase the amount that a public retiree under'sixtyfive years of age may earn in public employment without a reduction of his or her retirement benefits. SUMMARY OF PROVISIONS: The bill amends subdivision 2 of Section 212 of the Retirement and Social Security Law. It would allow a public retiree to earn up to $50,000 in public employment without reducing the retiree's pension. JUSTIFICATION:

LANZA, BORRELLO, HELMING -- read twice and ordered printed, and when printed to be committed to the Committee on Civil Service and Pensions AN ACT to amend the retirement and social security law, in relation to increasing the retiree public earnings cap THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Subdivision 2 of section 212 of the retirement and social security law, as amended by chapter 589 of the laws of 2019, is amended to read as follows: 2. The earning limitations for retired persons in positions of public service under this section shall be in accordance with the following table: For the year Earnings limitation 1996 $12,500 1997 $13,500 1998 $14,500 1999 $15,500 2000 $17,000 2001 $18,500 2002 $20,000 2003 $25,000 2004 $27,500 2005 and 2006 $27,500 2007 through 2019 $30,000 2020 [and thereafter] THROUGH 2023 $35,000 2024 AND THEREAFTER $50,000 § 2. This act shall take effect immediately. EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted. LBD06500-01-3

Why exactly is there a cap? Why do retirees 65 and older have no cap? Sounds like age discrimination to me. Please remove the cap altogether. Thank you.
What is the holdup on this ? This is a no-brainer & a MUST for NYS retirees that want to continue to work/contribute to their community.
As a seasoned, experience NYS Retiree smaller Towns and Villages are having tremendous difficulty in finding part time staff in the bookkeeping areas. Please take action on this as soon as possible. This will assist our very small communities in the ability to hire part time retirees. It's really a win-win.
Please pass this Bill, I'm retired live in NY. With this 30k cap we can't male it. Things have doubled or even certain things tripled. There are shortages of these civil service jobs, transportation, teachers etc. We need the money, you need the hired experience workers.

Well just got off the phone with retirement and she said this comes up every year and keeps getting stalled why is this not important enough to take care of...we earned are retirement and should noi have to suffer.also why are teachers more important..that's not right that they have no worries this year and I do..we elected you to help us now please do.
Having been retired for one year now from working two jobs. Back to work at one. Living on eastern Long Island with high property taxes and the extremely high cost of living in New York just can't cut it with the current $35,000 cap. Please get this bill passed now so that we retirees don't have to worry and possibly not have to move out of NY. It's a no brainer!
