Provides that no vapor products dealer, or any agent or employee of a vapor products dealer, shall sell or offer for sale at retail, or store flavored vapor product reasonably intended for sale in the state any flavored vapor product intended or reasonably expected to be used with or for the consumption of nicotine.

BILL NUMBER: S4399 SPONSOR: MARTINEZ TITLE OF BILL: An act to amend the public health law, in relation to the sale of flavored vapor products PURPOSE: The purpose of this bill is to strengthen the prohibition of the sale of flavored vapor products in the State of New York by closing a loophole exploited by retails and stores. SUMMARY OF PROVISIONS: Section 1. Subdivision 2 of section 1399-mm-1 of the public health law as amended by section one of part EE of chapter 56 of the laws of 2020 is amended to provide that a vapor products dealer, or any agent or employee of a vapor products dealer cannot sell or offer for sale any vapor product reasonable intended for sale at a store or retailer.

MARTINEZ -- read twice and ordered printed, and when printed to be committed to the Committee on Health AN ACT to amend the public health law, in relation to the sale of flavored vapor products THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Subdivision 2 of section 1399-mm-1 of the public health law, as added by section 1 of part EE of chapter 56 of the laws of 2020, is amended to read as follows: 2. No vapor products dealer, or any agent or employee of a vapor products dealer, shall sell or offer for sale at retail, OR STORE FLAVORED VAPOR PRODUCT REASONABLY INTENDED FOR SALE in the state any flavored vapor product intended or reasonably expected to be used with or for the consumption of nicotine. § 2.
